Resolution No. 11034 — A Resolution of the City Council of the City of Orange removing a
portion of Old Chapman Avenue from the City Street System.
2. SUMMARY
Adoption of Resolution No. 11034 will remove a portion of Old Chapman Avenue right -of -way
from the City Street System. This is a companion report for Agenda Item 3.30 that authorizes the
surplus and disposal of the same property.

7. BACKGROUND and DISCUSSION
This portion of Old Chapman Avenue was put out of service when the County of Orange
realigned and enlarged Chapman Avenue over the Chapman Grade in 1970. At the time, this
parcel was owned by the County of Orange. The City of Orange acquired ownership of the parcel
when the area was annexed to the City in 1976 (Annexation 311, Resolution 4438). The unused
roadway is a dead end road and has fallen into disrepair. The parcel is 8,426 square feet in size
and the topography is a steep hillside. The assessor's map still shows Old Chapman Avenue as a
public street.
The adoption of Resolution No. 11034 will remove that portion of Old Chapman Avenue that the
City owns from the City Street System and correct the Assessor's Map.

RESOLUTION NO. 11034
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ORANGE REMOVING A
PORTION OF OLD CHAPMAN AVENUE
FROM THE CITY STREET SYSTEM.
WHEREAS, the County Assessor's map shows a portion of Old Chapman Avenue
which has not been used and is no longer needed for street purposes as a part of the City's
street system; and
WHEREAS, the City Council of the City of Orange desires to amend the City's street
system, by removing that portion of Old Chapman Avenue located east of Cliffway Drive; and
WHEREAS, the City of Orange will retain all fee rights to that portion of the street
removed from the City street system.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Orange
as follows:
Section 1. The foregoing recitals are true and correct.
Section 2. That portion of Old Chapman Avenue located east of Cliffway Drive as
generally depicted on the map attached as Exhibit B and more particularly described in Exhibit
A , is hereby removed from the City street system effective upon recordation of this Resolution
in the Official Records of the County of Orange, State of California (the "Official Records ").
Section 3. As the underlying fee owner, the City of Orange retains all rights in fee
over the property depicted in Exhibit B , and more particularly described in Exhibit A .
Section 4. The City Clerk is hereby authorized and directed to cause a certified
copy of this Resolution, attested by the City Clerk under seal, to be recorded without
acknowledgement, certificate of acknowledgement, or further proof in the Official Records of
the County of Orange.
Section 5. From and after the date a certified copy of this Resolution is recorded in
the Official Records, that portion of Old Chapman Avenue located east of Cliffway Drive as
generally depicted on the map attached as Exhibit B and more particularly described in Exhibit
A, shall no longer constitute a public street and is hereby removed from the City street system.
Section 6. All actions heretofore taken by the officers, employees and agents of the
City with respect to the removal of the street and the recordation of any instrument relating to any
and all of the real property and /or parcel described in Section 2 of this Resolution are hereby
