SR - - MEMO TO COUNCIL - CITY'S RESPONSE TO HOMELESS CRISIS City of Orange City Manager's Office Memo To: Honorable Mayor and Members of the City Council From: Rick Otto, City Manager Date: September 25, 2017 Subject: City of Orange's Response to Homeless Crisis Overview Homelessness in Orange County has become one of the most critical issues facing the county at this time. In recent years, there has been a number of regional efforts to address homelessness including the Commission to End Homelessness as well as enhanced non-profit coordination. While there have been great strides in the establishment of new shelters and programs, unfortunately, due to a number of circumstances, the amount of homeless individuals that reside in Orange County has grown. Per the county-wide Point in Time count in January 2017, there are nearly 4,800 homeless individuals living in the county, a 7.6% increase over the 2015 count. Orange has not been immune from this situation. While much of the homeless population in Orange reside in the Santa Ana River area, our parks, libraries and businesses have also been areas in which homeless individuals have gathered. The purpose of this report is to address what has been the City's response to this issue as well as options in the future as to how we can further enhance our approach. This report and attached Power Point presentation has been prepared based on City Council direction from the September 12t�' meeting and includes the following: 1. A review of the impacts of homelessness on City operations (found in attached Power Point), 2. A review of how the Orange Police Department and the City as a whole has addressed issues concerning homelessness in Orange (Power Point), 3. A review of what the role of the Orange Police Department will be in relation to future law enforcement efforts in the Santa Ana River area (Power Point), 4. A review of additional services and programs that could further enhance the City's homelessness response efforts, and 5. A review by the City Attorney of current codes and any recommended changes that may improve the City's efforts to address criminal activity. As the attached Power Point presentation suggests, Orange has been extremely proactive in addressing homelessness in Orange. The City Council and City staff have been significantly engaged,both locally and regionally.Further,our local non-profits have been a leader in the county in providing essential outreach and services. 1 '�-rEM: � � � DATE OF ME�TING: � � �� I � City of Orange City Manager's Office It is important to note that as we discuss the City's response to homelessness in Orange that we separate the discussion of our response within the City boundaries and our response within the Santa Ana River area("River"). This is an important distinction as the City has significantly more control and ability to address issues with homelessness in our City parks, trails, public spaces, neighborhoods, and business districts. As such, the City has had good success in preventing camping and criminal activity in our parks and public spaces. Specific to general enforcement, there are two Orange Municipal Code(OMC)sections that address camping restrictions: 12.48.045 which prohibits camping in City parks and 12.66.030 which prohibits camping and obstructing public rights-of-way including sidewalks and other public spaces. In addition, OMC section 12.48.090 prohibits individuals from being in City parks after posted operating hours. Conversely, as the Santa Ana River area is in the jurisdiction of the county of Orange and related agencies, our efforts has been hindered. While portions of the River are within the boundaries of the City of Orange, the River is owned and operated by the county. As such, the county is the primary jurisdictional authority for the River. While the county does have compatible park hours and right-of-way obstruction statutes, they have not been enforced by the Orange County Sheriff Department. While the Power Point presentation covers items 1, 2, and 3 noted above, I would like to elaborate more on how the Orange Police Department will be supporting the efforts of the Orange County Sheriff's Department as they establish a presence in the River. The Police Chief and I have long agreed that a comprehensive, regional approach to law enforcement services in the River is necessary to achieve the best results. To this end, City Council members, the Police Chief and myself have for some time petitioned various county officials to increase the Sheriff presence. Therefore, the City would like to thank the Board of Supervisars for directing the Sherif�s Department at their September 12`h meeting to begin dedicated, proactive law enforcement services in the River. To support the Sheriff's Department, OPD will be dedicating one police officer 50 hours per week. This will be in addition to the HEART Team (Homeless, Engagement, Assistance, Resource, Team) engagement. Specifically, OPD personnel will be working alongside Anaheim and Sheriff personnel as part of a multi jurisdictional task force. In doing so, OPD will be continuing their strategy of compassionate but firm enforcement. Existing Services and Programs Over the past several years, the City of Orange has been significantly engaged in addressing the challenges related to homelessness in our community. In summary, the City has implemented the following programs and delivered the following services: • Established the HEART team, which is comprised of two police officers that use a proactive approach in dealing with the homeless community and those with a mental illness for long term solutions. • Re-established the Bike Team, which is comprised of three police personnel which frequently engage in homeless related efforts. • Engaged in the law enforcement services in the River including responding to calls for service and limited proactive enforcement of penal codes. • Conducted focused law enforcement services in neighborhoods and business areas nearest to the River to help mitigate any negative impacts. 2 City of Orange City Manager's Office • Conducted frequent patrols of the Santiago Creek area to ensure the safety of trail users and adjacent neighborhoods. • Established private security patrols in selected City parks and Main Library. • Established an internal Homelessness Task Force comprised of representatives from nearly every City department that meets quarterly to compare experiences and to share ideas to address impacts. • Participated in regional homelessness efforts including the North Orange County Service Area Committee that is led by the county's Director of Care Coordination, Susan Price. • Joined local faith-based organizations, including One Church in Orange, in frequent roundtable meetings to discuss and develop strategies to address homelessness in the City of Orange. • Supported Mary's Kitchen (through a lease of City-owned property) and other non-profits as they deliver needed services to the homeless community. � Approved the first SB 2 transitional homeless shelter in Orange County by supporting HomeAid in their establishment of a 56-bed family shelter in Orange. Additional Services and Programs Currently, the City commits approximately $1.0 million annually to addressing homelessness issues in Orange. This is a significant expense that was almost non-existent just two years ago. Nevertheless, given the current state of homelessness in Orange, there is a need for the City to dedicate more resources for this issue. Provided below are optional service level enhancements that the City Council may want to consider: 1. Establish two Police Officer positions to be solely responsible to respond to homelessness calls for service as well as be proactive throughout the community. These two positions will be in addition to the HEART team. To accomplish this, it is proposed that the positions be funded through overtime hours of existing staff. As OPD is not at full staffing due to industry-wide challenges with recruiting and hiring police officers, establishing the "positions" through overtime can be implemented immediately. The approximate cost of these dedicated positions is $200,000 annually. Chief Kisela will evaluate the program after the first three months to determine its effectiveness. 2. Increase Private Security Presence at parks and libraries. Currently, the City expends approximately $100,000 per year for private security services. It is recommended that the City increase the contract by an additional $40,000 to increase the amount of hours per week for coverage. This will provide for patrol services at additional parks as well as increase the amount of coverage at the Main Library. 3. Establish a City Council Ad Hoc Committee to formally engage with county Board of Supervisors to ensure the interests of Orange citizens and businesses are being met.While individually, City Council members have engaged with county officials, a coordinated effort through an Ad Hoc Committee will improve communications between the county and city. 4. Coordinate with local non-profits to encourage the establishment of additional transitional and permanent housing with the intention to serve the City's fair share homeless individuals throughout the community. This can be accomplished through the establishment of a task force of City, county and non-profit representatives to seek out funding sources and appropriate locations. 3 City of Orange City Manager's Office Review of OMC for Quality Life Issues Per City Council direction,the City Attorney reviewed the City of Orange Municipal Code(OMC) and specifically those codes that relate to quality of life type issues, such as, loitering and soliciting for money. In his review, he notes that although the OMC does not specifically prohibit such activity, the California Penal Code does address this and for the most part controls the field prohibiting local laws. There is one area that he believes a new ordinance could be beneficial. The new ordinance would prohibit "aggressive solicitation." This ordinance would prohibit, the asking, begging or solicitation of alms in an aggressive manner in any place open to the general public, whether publicly or privately owned, including but not limited to any sidewalks, streets, alleys, driveways, parking lots, parks, plazas, buildings, doorways and entrances to buildings, gasoline service stations, and the grounds around or enclosed by buildings. Aggressive manner would include approaching people in a manner that would cause a reasonable person to fear bodily harm, touching or grabbing another after that person has said no to the solicitor, continuing to ask after being told no, blocking or interfering with the free passage of persons and other actions which would cause fear or apprehension in a reasonable person. If the City Council is interested in considering such an ordinance, the City Attorney will bring it for First Reading at the October l Ocl' City Council meeting. Conclusion As stated at the beginning of this memo, homelessness in Orange County has become one of the most critical issues facing the county. As such, it is essential that county and city jurisdictions work collaboratively to engage in short and long-term solutions. Here in Orange, the City has been proactive in addressing the impacts of homelessness on the community. Nevertheless, more needs to be done as our residents and businesses are increasingly feeling the impacts. While this report includes a number of options to enhance our responsiveness, I welcome the City Council's feedback and direction on this issue.
