SR - - LEWIS STREET REORGANIZATION DETACHMENT OF TERRITORY1. SUBJECT Local Agency Formation Commission ( LAFCO) Lewis Street Reorganization RO 17 -01 Application. 2. SUMMARY The redevelopment of the former St. Callistus Church site in Garden Grove has revealed an irregular city boundary line. The result is a small portion of the project is in the City of Orange. Therefore, the City of Garden Grove has submitted a LAFCO application for detachment of territory (.901 acres) from the City of Orange to the City of Garden Grove, which is referred to as the "Lewis Street Reorganization ". 13. RECOMMENDATION J Support Local Agency Formation Commission Application RO 17 -01 for detachment of territory (.901 acres) from the City of Orange, proposed "Lewis Street Reorganization ". 4. GENERAL PLAN IMPLEMENTATION Land Use Element Goal 7.0: Promote coordinated planning among City departments and agencies, property owners, residents, special districts, and other jurisdictions in the region. Policy 7.3: Coordinate planning efforts with adjacent cities, special purpose agencies, utilities, and community service providers. 7. DISCUSSION At their July 5, 2017 meeting the LAFCO Board formally received the proposed "Lewis Street Reorganization" application (RO 17 -01). The application that was submitted to LAFCO includes a detachment of one property, totaling approximately .901 acres, from the City of Orange to the City of Garden Grove. Specifically, the reorganization includes .18 acres owned by the Christ Catholic Diocese of Orange and .721 acres is the public- right -of -way in the City of Orange. Once the application was received by LAFCO, the 60 -day review period began and it ends on Monday, September 11, 2017. In conjunction with the City of Garden Grove processing a land use entitlement application for the former St. Callistus Church, it was discovered that a small portion of the project site is in the City of Orange. The reconfiguration of the Lewis Street Bridge during the SR 22 freeway widening project created this irregular city limit which did not create a problem until this proposed development project. Therefore, it was determined that the best practice is to detach the area of the project that is in the City of Orange to the City of Garden Grove. The proposed "Lewis Street Reorganization to the City of Garden Grove" is also a city boundary change which cleans up an inconsistent city limit that exists at Garden Grove Blvd and Lewis Street. Per LAFCO the City of Orange has two available actions for the City Council to consider: • Support this reorganization application which then allows this application to continue through the LAFCO process. Staff will be bringing back to the City Council a property tax exchange agreement with the City of Garden Grove for this parcel. • Oppose this reorganization during the 60 -day review period by adopting a resolution requesting LAFCO terminate the detachment proceedings. If the City of Orange adopts and transmits to LAFCO a resolution requesting termination of proceedings within the time period prescribed in Government Code section 56751, then LAFCO shall terminate the proceedings upon receipt of this resolution. This is commonly referred to as a City's veto power over detachments. Staff has reviewed the action being requested by LAFCO RO 17 -01, to determine what impact, if any, would result from these actions. The summary is below: Size of Area: This area is approximately .901 acres Property owner: Christ Catholic Church Facilities Corporation Proposal action before LAFCO: 1) Detach property from the City of Orange (- .901 acres) 2) Annex to the City of Garden Grove ( +.901 acres) Reason for Action given by applicant: Annex portion of vacated parcel (City of Orange) into the City of Garden Grove to join with remaining portion of parcel located in the City of Garden Grove to allow development to proceed in one jurisdiction. City Staff review: Based on existing conditions, the requested detachment is reasonable in that it cleans -up property lines and the city boundary caused by the 22 freeway widening project. Recommendation Based on staff's review of this LAFCO reorganization application staff is recommending support of LAFCO Lewis Street Reorganization RO 17 -01.
