SR - - SECOND READING ORDINANCE NO 01-17ORDINANCE SECOND READING February 14, 2017 1. SUBJECT Second Reading and adoption of an Ordinance of the City Council of the City of Orange approving Zone Change No. 1282 -16 to change the zone of property located at 2050 and 2140 West Chapman Ave. from office professional (O -P) to general business (C -2) consistent with the existing General Plan land use designation of general commercial (Max 1.0 FAR) (GC). 2. SUMMARY The introduction and First Reading of the above - entitled Ordinance was approved at a Regular Council Meeting on January 10, 2017. The Ordinance is now presented for Second Reading by title only, and adoption. Vote at First Reading: AYES: Alvarez, Whitaker, Smith, Murphy, Nichols NOES: None ABSENT: None 3. RECOMMENDATION Adopt Ordinance No. 01 -17. 4. ATTACHMENTS Ordinance No. 01 -17 ITEM 9.1 1 2/14/17 ORDINANCE NO. 01-17 AN ORDINANCE OF THE CITY COUNCIL APPROVING ZONE CHANGE NO. 1282 -16 TO CHANGE THE ZONE OF PROPERTY LOCATED AT 2050 AND 2140 WEST CHAPMAN AVENUE FROM OFFICE PROFESSIONAL (O -P) TO GENERAL BUSINESS (C -2) CONSISTENT WITH THE EXISTING GENERAL PLAN LAND USE DESIGNATION OF GENERAL COMMERCIAL (MAX 1.0 FAR) (GC). ZONE CHANGE NO. 1282 -16 APPLICANT: WITNESS INTERNATIONAL LLC (TOMMY CHIN HO LIN) AND LIVING BRANCHES LLC (EDDY CHIN YU LIN AND EVE KUO WAN LIN). WHEREAS, the existing zoning designation for the subject site is Office Professional (O -P) as shown on Exhibit A of this Ordinance; and WHEREAS, the Applicant proposes to change the zoning to General Business (C -2) as shown on Exhibit B of this Ordinance; and WHEREAS, the General Plan Land Use Element designation for the site is General Commercial (Max 1.0 FAR) (GC); and WHEREAS, in accordance with State planning law (Government Code §65860), the City must establish consistency between the General Plan and its zoning. Both existing and proposed zoning would be consistent with the General Commercial (Max 1.0 FAR) (GC) General Plan Land Use designation of the site. Furthermore, Implementation Program I -1 of the General Plan Implementation Plan calls for consistency between General Plan and zoning designations to be established. Therefore, the General Plan EIR already contemplated and evaluated the proposed Zone Change and the associated reasonably foreseeable development of the site; and WHEREAS, the City Council of the City of Orange is authorized by Government Code Section 65850 to adopt ordinances amending the City's zoning code; and WHEREAS, Zone Change No. 1282 -16 was filed by Witness International LLC (Tommy Chin Ho Lin) and Living Branches LLC (Eddy Chin Yu Lin and Eve Kuo Wan Lin) in accordance with the provisions of the City of Orange Municipal Code; and
