SR - RES-10993 - MITIGATED NEGATIVE DECLARATION FOR WIDENING OF PORTIONS OF KATELLA AVENUE1. SUBJECT
Resolution No. 10993 - A Resolution of the City Council of the City of Orange approving and
adopting Mitigated Negative Declaration (MND) No. ENV 1851 -16 and a Mitigation Monitoring
and Reporting Program for the widening of portions of Katella Avenue and Tustin Street,
approving Preliminary Plans therefore, and making certain findings in connection therewith.
2. SUMMARY
The Katella Avenue and Tustin Street Intersection Widening Project (Capital Improvement Project
No. 3073, SP -3933) will provide for improvements to the northwest comer of the intersection. The
improvements will consist of the construction of an additional southbound -to- westbound dedicated
right turn lane on Tustin Street. Additionally, the project will add a bus turnout for westbound
Katella Avenue west of Tustin Street.
The City prepared MND No. ENV 1851 -16 to evaluate the potential environmental impacts of the
project in compliance with the California Environmental Quality Act (CEQA). The Council is
being asked to review and consider the information presented, adopt the MND, and approve the
preliminary project plans.
The project has received Measure M funding through OCTA from its Comprehensive
Transportation Funding Programs (CTFP) for Engineering, Right of Way, and Construction at a
75/25 reimbursable rate. The grant total received for Engineering, Right of Way, and construction
is $1,218,882.

comply with the City's National Pollutant Discharge Elimination System (NPDES) Municipal

7. DISCUSSION and BACKGROUND
The Public Works Department is proposing a project to widen the northwest corner of the Katella
Avenue/Tustin Street intersection. The project will construct a southbound -to- westbound
dedicated right turn lane on Tustin Street. The project will also include the construction of a bus
turnout for westbound Katella Avenue west of Tustin Street. Implementation of the proposed
project may require acquisition of linear "slivers" of right -of -way (ROW) to provide the necessary
additional public street dedication to allow the construction of the proposed street improvements
along the west side of Tustin Street north of Katella Avenue, and on the west side of Katella
Avenue west of Tustin Street. If implemented as designed on the preliminary plans, the project
will protect the existing El Pollo Loco, The Vitamin Shoppe, and AT &T structures in place.
Construction will affect utilities, landscaping, parking, driveways, and signage at adjacent
commercial properties. However, as we move forward with further design of the project, one or
more conditions to the implementation of the project, as currently designed, may fail to be met as
a result of subsequent studies, reviews and proceedings involving the exercise of discretion by the
City, the City Council, or any department of the City.
The Public Works Department has prepared preliminary construction plans for the widening of the
Katella Avenue at Tustin Street intersection. This intersection is currently on the City's list of 44
critical intersections in the City. These intersections are classified in the City's General Plan
Circulation Element as intersections where additional or special purpose travel lanes are necessary

to accommodate existing or anticipated traffic demands. Existing traffic volumes at the intersection
result in extensive traffic delays, and congestion of the intersection during peak traffic periods.
The City has prepared MND No. ENV 1851 -16, a study that analyzes the project's potential for
creating physical environmental impacts in compliance with the CEQA. The MND concludes that
the project will not have a significant adverse effect on the environment, with the implementation
of mitigation measures and/or existing regulations related to aesthetics, air quality, biological
resources, cultural resources, geology and soils, hazards and hazardous materials, and hydrology
and water quality. The identified mitigation measures and /or existing regulations ensure that
significant or potentially significant impacts resulting from the project are reduced to less than
significant levels.
The City Council is being asked to review and consider the information presented in the MND
prior to rendering a decision on the project. The MND and the Notice of Intent (NOI) announcing
the availability of the MND for public review was sent out on January 9, 2017 for distribution and
review by regulatory agencies such as the Orange County Transportation Authority, Orange
County Health Care Agency, and South Coast Air Quality Management District. The NOI was
concurrently filed with the Orange County Clerk, posted onsite, and mailed to all property owners
and tenants within 300 -feet of the proposed intersection project limits. The NOI was also published
in the Orange City News on January 11, 2017. The MND was made available to the public at
Orange City Hall, local libraries, and on the City's website. The 20 -day review period ran from
January 11, 2017 through January 30, 2017. Comments received during the review period and
responses to comments are attached for City Council consideration.
With the approval of the MND and preliminary plans for the project, the Public Works Department
will begin the process of appraisal preparation, ROW acquisition, and negotiations. The City, upon
receipt of the appraisals, will review the offers and request City Councils approval to purchase and
acquire any and all real property required for completion of the project. After ROW acquisition,
the Public Works Department will finalize the construction plans and request City Councils
authorization to bid construction of the proposed street improvements.
