BACKGROUND and DISCUSSION Section 1806 of the California Streets and Highways Code provides that, except upon the annexation of territory to the City, no public or private street or road shall become a City street or road until the City Council, by resolution, has caused the street or road to be accepted into the City Street System. A portion of Manchester Avenue and The City Drive, north of Chapman Avenue, erroneously show on the Assessor's map as parcels (APN's 137 - 471 -19, 22, 24, 30, and 41) and not public street right -of -way. Without City Council action incorporating APN's 137 - 471 -19, 22, 24, 30, and 41 that are currently utilized as public street right -of -way, the Assessor will not change their map to reflect the current street configuration. This resolution will incorporate that public street right -of -way into the City Street System, thus allowing the Assessor to correct the configuration on their maps. Although these parcels are in the public street right -of -way, they are not considered public streets until the City adopts a resolution to expressly accept them into the City Street System, and only then it will be shown as a public street by the Orange County Assessor in the Assessor's map book. Upon the adoption of Resolution No. 10991 and recordation of a certified copy thereof in the Official Records of the County of Orange, the Assessor's map book will be revised by the County Assessor to correctly show those parcels as public streets. 8.
