SR - AGR-6438 - YORBA PARK RENOVATION PROJECT1. SUBJECT Yorba Park Renovation Project 2. SUMMARY Due to settlement caused by the former landfill at Yorba Park, the 8.5 acre site needs to be renovated. The project is comprised of four phases which include grading, replacement of the vapor extraction system (to be completed by the County of Orange), park re- establishment, and as funding is available replacement of the restroom/storage building. County of Orange settlement fees and insurance payments received last year need to be appropriated to the project, as well as adoption of an Addendum to the previously- approved Mitigated Negative Declaration (MND) is required for California Environmental Quality Act (CEQA) compliance. In accordance with approval of the Yorba Park Renovation Project, it is recommended the City Council award Phase I, Yorba Park Grading Project, to C.H.I. Construction. 3. RECOMMENDED ACTION 1. Approve and adopt the Addendum to previously- approved MND No. ENV 1674 -01; 2. Authorized the transfer of $765,260 from the unreserved fund balance of the General Fund to the Capital Projects Fund (500); 3. Authorize the appropriation of $765,260 from the unreserved fund balance of the Capital Projects Fund (500) to account 500.5011.56020.20135; and 4. Accept the bid withdraw request from the apparent low bidder, El Camino Asphalt Paving Corp., and award the contract for Bid No. 167 -05, SP -3960, Yorba Park Grading Project in the amount not to exceed $424,732 to the next lowest responsible bidder, C.H.I. Construction, and authorize the Mayor and City Clerk to execute on behalf of the City. 4. FISCAL IMPACT Sufficient funds are available in the unreserved fund balance of the General Fund to support the requested appropriation. Upon approval of the recommended actions, sufficient funds will also be available in the Capital Projects Fund to support the requested appropriation. Upon approval of the requested appropriation funds will be available to cover the cost of the grading contract as follows: 500.5011.56020.20135 ( Yorba Park) $424,732 5. STRATEGIC PLAN GOAL(S) lb. GENERAL PLAN IMPLEMENTATION Goal 3.0 Ensure adequate maintenance of public rights -of -way to enhance public safety and improve circulation. Policy 3.1 Continue to maintain and repair sidewalks and pavement surfaces on public rights -of- way. Goal 5.0 Provide recreational facilities and programs that adequately serve the needs of residents. Policy 5.1 Maintain existing City parks at levels that provide maximum recreational benefit to City residents. 7. DISCUSSION and BACKGROUND Background In early July, staff from the City and the County of Orange (County) met to coordinate improvement efforts at Yorba Park. The meeting focused on moving forward with implementation of improvements outlined in the November 2015 Settlement Agreement. Per the Settlement Agreement, the City is required to level and grade the property to achieve proper drainage for the landfill site (Phase I). At the completion of that effort, the County is required to replace the aging vapor extraction and monitoring system (Phase II). Also per the Settlement Agreement, the County is assuming responsibility for oversight and management of the methane monitoring system. The City's grading portion of the project is significant and requires demolition and leveling of almost the entire park site. In conjunction with the grading, the contractor will be reconstructing approximately 50% of the parking lot as well as installing solar lighting for the parking lot. At the conclusion of the grading work and installation of the vapor system the park site will essentially be cleared. As such, we are taking the opportunity to evaluate options to significantly improve the park to be more attractive and functional while still being cognitive of the operational challenges of a park located on a closed landfill. Phase III -Park Re- Establishment, will include all new irrigation, turf and shrub establishment; installation of a new flag pole, new trash receptacles, as well as new fencing, watering stations and benches for the dog park. These amenities replace the existing amenities with two enhancements; one, adding drought tolerant shrub plantings strategically placed to improve the aesthetic experience while both visiting and driving by the park; and two, expanding the dog park from 2 acres to 2.4 acres to allow for a center fence in the large dog area for improved turf management. The new gated center fence line will allow half of the large dog area to be closed off, allowing turf to recover or for maintenance purposes during time of turf renovation, while allowing the other half to remain open. A site improvement plan is attached for reference. The site improvement plan also includes the following add - alternate amenities, which will be considered as funding is available: decomposed granite path for access to the Santiago Creek Bike Trail, new picnic tables in the passive park area, additional benches and small shade canopies in the dog park, black vinyl coating for the dog park fencing, and trees in both the passive area and within the dog park. Other add - alternate items for consideration if funding is available, however not represented on the attached site improvement plan, include portable dog exercise equipment, and a sod installation verses stolon alternative for the dog park area to allow the dog park to re -open approximately 12 weeks before the remainder of the park. Phase IV, to be considered if funding is available, is the demolition of the existing restroom building and installation of a new restroom with storage. Construction documents are currently being developed for Park Re- establishment and Restroom Replacement. These phases are anticipated to be bid in early spring 2017. California Environmental Quality Act (CEQA) The City has prepared an Addendum to previously- approved MND No. ENV 1674 -01 in compliance with CEQA. The Addendum analyzes the environmental impacts associated with the proposed modifications, which required minor revisions to the aesthetics, air quality, hazards and hazardous materials, noise, traffic, and parking analyses. The analyses concluded that the proposed modifications will not result in any new impacts or increase the severity of impacts beyond those previously disclosed in the previously- approved MND (which was adopted by the City Council in December 2003). The existing regulations and mitigation measures listed in the previously- approved MND ensure that impacts resulting from the project modifications remain at less than significant levels. Therefore, nothing further is required or warranted for CEQA compliance. The City Council is being asked to review the information presented and to approve and adopt the Addendum as step one in moving forward with this project. Fundin The City's basic preliminary cost estimate for the project is $1.97 million. The additional list of add - alternate items is estimated at $557,212. Combined, the estimated total project cost, including contingency, is $2.5 million. Funding currently available for the project includes the County settlement fee ($250,000) and insurance payment ($515,260) received in 2015. Upon approval of the recommended actions, these monies will be appropriated to the Yorba Park renovation project. In addition, previous Fund 500 monies already allocated to Yorba Park in the amount of $229,000 provide for a total of $994,260. Staff is actively evaluating other available sources to close the $970,804 to $1.53 million gap. Park Acquisition Funds could be available for this project. The gap will need to be identified upon award of Phase III - Park Re- Establishment, anticipated in spring 2017. The cost analysis is detailed below. The grading scope of work also consists of, but is not limited to, site clearing and grubbing, adjustment or replacement of the existing fence along Chapman Ave., removal and replacement of approximately 50% of the asphalt concrete parking lot, install of a drainage inlet, install solar LED parking lot lighting, curb and gutter and sidewalk replacement along Chapman Ave, and removal of the existing old tot lot base currently in the dog park. The bid solicitation was advertised on October 13, 2016 for a period of four weeks, and bids were opened on November 10, 2016. After review of the request it was determined acceptance of the withdrawal is in the City's best interest. It is recommended the City Council award a contract for Bid No. 167 -05, SP -3960; Yorba Park Grading Project in the amount of $386,120, plus a 10% contingency of $38,612 for a total not exceed amount of $424,732 to C.H.I. Construction as the next lowest responsible bidder. C.H.I. submitted a complete bid package and received acceptable reference checks. Phase I Construction is scheduled to begin in January 2017 and is expected to be completed within forty - five calendar days barring any weather delays. Conclusion Grading is Phase I of the needed improvements planned for Yorba Park. The County is finalizing construction documents for Phase II — Vapor Extraction System replacement. Construction documents are being developed for Phase III — Park Re- Establishment and Phase IV — Restroom Replacement. The Community Services and Public Works Departments are working closely with the County to coordinate efforts to minimize the park closure and ensure a smooth and continuous flow of work. It is anticipated the park will be closed for eight to ten months to complete all phases of work. Community Services has met with the Orange Dog Park Association to notify them of the project, the closure, and to seek input on the redesign. The Association has expressed their support for the project. A letter to residents surrounding Yorba Park notifying them of the project and tonight's agenda item was mailed the first week of December. 8.
