SR - NEG-1850-16 - APPROVAL OF PLANS FOR TUSTIN / MEATS INTERSECTION RIGHT TURN LANE PROJECT1. SUBJECT Approval of plans and specifications, and authorize right of way acquisition for the Tustin/Meats Intersection Right Turn Lane Project (SP- 3892). 2. SUMMARY Plans and specifications have been completed for the Tustin/Meats Intersection Right Turn Lane Improvements, under the Orange County Transportation Authority (OCTA) Renewed Measure M (M2) Comprehensive Transportation Funding Program. The project can now move to the right of way acquisition phase. The City prepared Mitigated Negative Declaration (MND) No. ENV 1850 -16 to evaluate the potential environmental impacts of the project in compliance with the California Environmental Quality Act (CEQA). The Council is being asked to review and consider the information presented, and adopt the MND and associated Mitigation Monitoring and Reporting Program. 3. RECOMMENDED ACTION 1. Adopt Mitigated Negative Declaration No. ENV 1850 -16 and the associated Mitigation Monitoring and Reporting Program. 2. Approve plans and specifications and authorize right of way acquisition for the Tustin/Meats Intersection Right Turn Lane Improvements Project. 4. GENERAL PLAN IMPLEMENTATION Circulation and Mobility Element Goal 1.0 Provide a safe, efficient, and comprehensive circulation system that serves local needs, meets forecasted demands and sustains quality of life in neighborhoods._ Policy 1.2: Identify key intersections and streets with historical or projected traffic congestion problems and apply creative traffic management measures to improve overall circulation. 7. DISCUSSION and BACKGROUND The intersection on Tustin Street and Meats Avenue was recently widened on three of the corners to accommodate high traffic volume. The southeast corner was not improved due to budget constraints. Public Works Staff has recently received grant funding from OCTA for the project engineering and right of way phase through the Intersection Capacity Enhancement (ICE) grant program. At this time, staff would like to proceed with the right of way phase for the remaining corner. Staff is proposing to widen Tustin Street to accommodate a single right turn pocket from northbound Tustin Street to eastbound Meats Avenue. A bus bay will also be added on the south side of Meats Avenue. Although staff is requesting approval of plans at this time, the actual advertisement for construction bids and construction may be up to two years from now due to right of way acquisition. A grant for $1,424,713 have been obtained from OCTA for right of way acquisition. The widening would require acquisition of an area of commercial property on the southwest quadrant of the intersection. Two parcels will be affected and partial acquisitions are planned. Business relocations are required. It is unknown at this time how long the acquisition of the needed parcels will take. Staff is currently applying for construction funds through the same OCTA grant program. Construction is tentatively scheduled to begin in Summer 2018 and is expected to be completed within ninety calendar days. The City has prepared MND No. ENV 1850 -16, a study that analyzes the project's potential for creating physical environmental impacts, in compliance with the CEQA. The MND concludes that the project will not have a significant adverse effect on the environment, with the implementation of mitigation measures requiring dust and noise control measures during construction, and requiring proper testing, removal and disposal of onsite asbestos containing materials, lead -based paint, and lead in soils. The identified measures ensure that significant impacts resulting from the project are reduced to less than significant levels. The City Council is being asked to review and consider the information presented in the MND prior to rendering a decision on the project. The Notice of Intent (NOI) announcing the availability of the MND for public review was filed with the Orange County Clerk, posted onsite, and mailed to all property owners and tenants within 300 -feet of the project limits. The NOI was also published in the Orange City News on October 5, 2016. The MND was made available to the public at Orange City Hall, the Main Library and History Center, the Taft Branch Library, and on the City's website. The 20 -day review period ran from October 5, 2016 through October 24, 2016. Comments received during the review period and responses to comments are attached for City Council consideration. 8.
