SR - - REQUEST FOR 3-HOUR TIME LIMIT PARKING AND RED CURB N SHATTUCK PLACE1. SUBJECT Appeal of Traffic Commission's denial of applicant's request for 3 -hour time limit parking and red curb on N. Shattuck Place. 2. SUMMARY This appeal is to overturn the Traffic Commission's denial of applicant's request to provide turn over parking for the driveway serving the business complex at 853 N. Shattuck Place and 3 -hour time limit parking in front of the church at 840 N. Shattuck Place. 3. RECOMMENDED ACTION Request that the City Council consider the appeal. 4. FISCAL IMPACT None. 5. STRATEGIC PLAN GOAL(S) 1.5 Provide and maintain infrastructure necessary to insure the safety of the public. 6. GENERAL PLAN IMPLEMENTATION Growth management Goal 1.0: Reduce traffic congestion with the City. Policy 1.10: Apply traffic - calming measures, where appropriate, to residential neighborhoods affected by cut - through traffic in accordance with the City's Residential Neighborhood Traffic Management Program. 7. DISCUSSION and BACKGROUND On April 25, 2016, the Traffic Division received a request to install time limited parking and red curb serving the business complex at 853 N. Shattuck Place and time limited parking in front of the church at 840 N. Shattuck Place. The request was placed on the June 8, 2016 Traffic Commission agenda, once a parking occupancy study had been completed by staff. The Traffic Commission continued the item for further study and follow -up. The Traffic Commission took evidence at its August 10, 2016, meeting and after deliberation denied the applicant's request. A timely appeal was filed on behalf of the applicant by Councilmember Alvarez stating that the applicant believes persons from nearby apartments are using the available parking thereby creating a lack of parking for the businesses. The following summarizes the timeline for processing this request: April 25, 2016 City staff receives initial request from Glen R. Nelson, Steven A. Nelson and Pastor Bubba Lipscomb. April /May 2016 City staff performs parking occupancy study and traffic study related to red curb request. June 8, 2016 The N. Shattuck Place time - limited parking and red curb request is considered at the Traffic Commission meeting. The Traffic Commission takes the following action: Direct a 30 -day enforcement of the area, approve the red curb request, and bring the item back to the Traffic Commission for further consideration at the August 10, 2016 Traffic Commission meeting. June 9 -July 10, 2016 A 30 -day Police Department targeted enforcement of parking regulations along N. Shattuck Place occurred. July 11, 2016 Orange Police Department issues memo summarizing the results of the targeted enforcement efforts. Four citations were issued, three for expired registration and one for an oversized vehicle. One vehicle was towed for violating the 72 hour time limit. Officers conclude the area is not overly impacted during business hours (8 am to 5 pm) and parking is generally available for business patrons each day. July 13, 2016 July 14 -July 21, 2016 Installation of red curb at the driveway serving 853 N. Shattuck Place. Traffic Division parking enforcement efforts. occupancy study following targeted 2 August 10, 2016 The N. Shattuck Place time - limited parking request is considered at the Traffic Commission meeting. After deliberation, a motion to deny is made, citing an overnight parking issue rather than lack of available parking during daytime business hours. The Traffic Commission takes the following action: Approve the staff recommendation to deny the request. August 25, 2016 The Traffic Division receives an appeal application from Councilman Mike Alvarez requesting the City Council review the findings of the Traffic Commission and the decision to deny the request of the applicant. Prior to each of the scheduled Traffic Commission meetings, 90 public notices were mailed to properties that are contained within the 300 foot radius of the requested parking restriction. In response, one letter of support was received by the City via email and was included in the June 8, 2016, staff report to the Traffic Commission. One resident appeared at the August 10, 2016 Traffic Commission meeting and comments that she is concerned vehicles would opt to park in the nearby residential neighborhood if restricted along N. Shattuck Place. 8. PLANNING AND ENVIRONMENT 11.1 Appeal of Traffic Commission's denial of applicant's request for 3 -hour time limit parking and red curb on N. Shattuck Place. (S4000.S.3.1.1) City Manager Otto introduced the item. City Traffic Engineer Jacki Scott presented the staff report, and answered Council's questions regarding the parking analysis done by staff. Sergeant Brian Marcotte, Orange Police Department, answered Council's questions regarding the types of citations issued during the 30 -day enforcement of parking regulations. Public Speakers: Glen Nelson — requested that Council consider a 3 -hour time limit parking and red curb at N. Shattuck Place. Pastor Bubba Lipscomb — requested that Council approve the request. Steve Nelson — requested that Council approve the request. Philip Nelson — requested that Council approve the request. Adam Feliz, Traffic Commission Member — requested that Council uphold the Traffic Commission's decision as limiting the parking on that street will only impact the surrounding area. PAGE 13 CITY COUNCIL MINUTES OCTOBER 11, 2016 11. PLANNING AND ENVIRONMENT (Continued) Councilmember Alvarez stated that he brought this issue forward so that Council could review the situation on N. Shattuck Place and consider a 3 -hour parking limit or a no overnight parking restriction as a resolution to the parking difficulties faced by the church and surrounding businesses on this street. Following discussion, Council agreed to approve a 3 -hour parking limit, 8:00 a.m. to 8:00 p.m., seven days a week, for the designated areas in the application submitted to the Traffic Commission (100 feet in front of each address at 853 N. Shattuck Place and 840 N. Shattuck Place, for a total of 200 feet). MOTION — Whitaker SECOND — Alvarez AYES — Alvarez, Whitaker, Smith, Murphy, Nichols Moved to grant the appeal and approve a modified version of the applicant's request for a 3 -hour time limit parking from 8:00 a.m. to 8:00 p.m., seven days a week, in the designated area; and request that staff bring back a report in six months with an update on the effect of the parking restriction. 12. PUBLIC HEARINGS 12.1 Adoption of the 2016 Editions of the California Building Standards Code amending Title 15 of the Orange Municipal Code. (A2500.0) Time set for a public hearing to consider adoption of the 2016 Editions of the California Building Standards Code. THE MAYOR OPENED THE PUBLIC HEARING; AND THERE BEING NO SPEAKERS, THE MAYOR CLOSED THE PUBLIC HEARING. ORDINANCE NO. 09 -16 (FIRST READING) An Ordinance of the City Council of the City of Orange amending Title 15 of the Orange Municipal Code adopting and amending the 2016 Editions of the California Codes and Related Model Codes with Appendices relating to the Building Codes.
