SR - RES-10976 - CITYWIDE SALARY SCHEDULE1. SUBJECT Resolution No. 10976 — A Resolution of the City Council of the City of Orange authorizing and approving a Citywide Salary Schedule in accordance with the requirements of California Code of Regulations, Title 2, Section 570.5. 2. SUMMARY The City of Orange contracts with the California Public Employees Retirement System (CalPERS) to provide retirement benefits for its employees. As a public employer, the City must abide by the Government Code when establishing and reporting its compensation for its employees. The California Code of Regulations (CCR) Title 2, Section 570.5 (Section 570.5) sets forth the requirements of public employers on reporting public employee pay rates. The Resolution will satisfy the requirements of Section 570.5. 13. RECOMMENDED ACTION Approve the Resolution. 14. FISCAL IMPACT None. 5. STRATEGIC PLAN GOAL(S) 4e. DISCUSSION and BACKGROUND CalPERS uses publicly available pay schedules in order to determine final compensation and to calculate retirement benefits for City employees. Section 570.5 of the CCR sets forth the requirements of this pay schedule. Section 570.5 states that publicly available pay schedules must meet all of the following requirements: • Has been duly approved and adopted by the employer's governing body in accordance with requirements of applicable public meeting laws; • Identifies the position title for every employee position; • Shows the pay rate for each identified position, which may be stated as a single amount or as multiple amounts within a range; • Indicates the time base for each pay rate; • Is posted at the office of the employer or immediately accessible for public review from the employer during normal business hours or posted on the employer's internet website; • Indicates an effective date and date of any revisions; • Is retained by the employer and available for public inspection for not less than five years; • Does not reference another document in lieu of disclosing the pay rate. Although all Memoranda of Understanding for all Bargaining Units and Resolutions for unrepresented staff are included on the City's website, Ca1PERS has advised staff that they do not meet all of the requirements of Section 570.5. As such, staff has verified with Ca1PERS that the Citywide Salary Schedule attached to Resolution No. 10976 meets the criteria set forth in Section 570.5. Additionally, each position in the Citywide Salary Schedule also references the Bargaining Unit or unrepresented group that the position belongs to in order for the user to obtain more information regarding compensation for the respective positions. With the accompanying agenda item for Resolution No. 10962, there are two salary schedules attached to the Resolution for this item. The first has an effective date of August 7, 2016, which is the date that the last salary increase for employees went into effect. The second schedule reflects a revision date and changes made by Resolution No. 10962, which is effective October 30, 2016. 18. ATTACHMENTS Resolution No. 10976 RESOLUTION NO. 10976 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE AUTHORIZING AND APPROVING A CITYWIDE SALARY SCHEDULE IN ACCORDANCE WITH THE REQUIREMENTS OF CALIFORNIA CODE OF REGULATIONS, TITLE 2, SECTION 570.5 WHEREAS, the City of Orange, hereinafter referred to as "City," contracts with the California Public Employees Retirement System to provide retirement benefits for its employees; and WHEREAS, per California Code of Regulations, Title 2, Section 570.5, the City must abide by the California Government Code when establishing and reporting compensation for its employees; and WHEREAS, the attached Citywide Salary Schedule must meet the following requirements: must be duly approved and adopted by the employer's governing body in accordance with requirements of applicable public meeting laws, identifies the position title of every employee position, shows the pay rate for each position, indicates the time base for each pay rate, is posted at the office of the employer or immediately accessible for public review during normal business hours or posted on the employer's internet website, indicates an effective date and date of any revisions, is retained by the employer and available for public inspection for a period not less than five years, and does not reference another document in lieu of disclosing the pay rate; and WHEREAS, the Citywide Salary Schedule, effective August 7, 2016, incorporates all salary ranges and base pay rates pursuant to the Employment Agreement with City Manager, dated October 4, 2015, Resolution No. 10888, Exhibit "A ", Resolution No. 10893, Appendix "A ", Resolution No. 10897, Exhibit "A ", Resolution No. 10900, Exhibit "A ", Resolution No. 10909, Exhibit "A ", Resolution No. 10924A, Exhibit "A ", Resolution No. 10932, Exhibit "A ", Resolution No. 10933, Exhibit "A ", Resolution No. 10946, Appendices "A" and "B ", and Resolution No. 10947, Exhibit "A "• and WHEREAS, the City Council approved Resolution No. 10962, which includes a new Salary and Wage Schedule for Part-Time and Seasonal Employees effective October 30, 2016, thereby making necessary a revised Citywide Salary Schedule effective October 30, 2016; and WHEREAS, the Citywide Salary Schedule will be updated by Resolution upon approval of any future City Council Resolutions that increase the pay of any positions listed in the Citywide Salary Schedule; 1 CITY COUNCIL MINUTES OCTOBER 11, 2016 3. CONSENT CALENDAR (Continued) 3.17 RESOLUTION NO. 10962 (C2500.J.4.7) A Resolution of the City Council of the City of Orange relating to the classification, compensation, and terms of employment for part-time and seasonal employees of the City of Orange effective July 1, 2016 through and including June 30, 2017 and repealing Resolution No. 10893 and amendments thereto, for said employees. ACTION: Approved Resolution No. 10962, and authorized staff to make the necessary budget adjustments and /or appropriations to the departments' salary and benefit accounts to fund the increased costs of the contract. 3.18 Number Not Used. 3.19 RESOLUTION NO. 10974 (C2500.J.4.4.1) A Resolution of the City Council of the City of Orange Approving the Memorandum of Understanding between the City of Orange and the Water Division Employees' Association (WDEA), Concerning Wages, Hours, and other Conditions of Employment Effective July 1, 2015, through and including June 30, 2017, and Repealing Resolution No. 10764 and Amendments thereto for said Employees. ACTION: Approved. 3.20 RESOLUTION NO. 10968 (C2500.J.4.3.1) A Resolution of the City Council of the City of Orange Repealing Resolution No. 10778 and Implementing the Memorandum of Understanding between the City of Orange and the Orange Fire Management Association Concerning Wages, Hours, and Other Conditions of Employment for the period of July 1, 2015, through and including June 30, 2017. ACTION: Approved. 3.21 RESOLUTION NO. 10976 (C2500.J.4) A Resolution of the City Council of the City of Orange authorizing and approving a Citywide Salary Schedule in accordance with the requirements of California Code of Regulations, Title 2, Section 570.5. ACTION: Approved. 3.22 RESOLUTION NO. 10979 (S4000.S.4) A Resolution of the City Council of the City of Orange summarily vacating a portion of Chapman Avenue, commonly referred to as Assessor's Parcel No. 231 - 061 -04, as excess street right of way that is no longer needed for street purposes.
