All other Commissioners were present. 1.4 PUBLIC PARTICIPATION: Chris Candelaria voiced concern with an issue he was having with the Code Enforcement staff. 1.5 CONTINUED OR WITHDRAWN ITEMS: None 1.6 PLANNING MANAGER REPORTS: None 2. NEW HEARING: 3.1 CONDITIONAL USE PERMIT NO. 2987 -15; MAJOR SITE PLAN REVIEW NO. 0837 -15; DESIGN REVIEW NO. 4821 -15; AND ADMINISTRATIVE ADJUSTMENT NO. 0237-15 — GLASSELL TOWNHOMES The applicant proposes to construct a new 40 unit townhouse development within the Residential Multiple Family (R -3) zoning district. The application includes a request for a conditional use permit for an additional third story and minor adjustments to building setbacks and driveway length. LOCATION: 2830 N. GLASSELL STREET NOTE: The proposed project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per State CEQA Guidelines Sections 15332 (Class 32 — In -fill Development Projects) because the project meets the following criteria: a. The project is consistent with the existing General Plan designations, General Plan policies and applicable zoning designations and regulations in that the intended townhouse use is a listed permitted use consistent with the intent of the land use designation. b. The project is in the City on a site less than five acres and is substantially surrounded by urban uses. c. The project site has no value as habitat for endangered, rare or threatened species in that the site is void of any vegetation or landforms. d. The project has been evaluated for significant effects relating to traffic, noise, air quality, and water quality and no significant effects have been identified in that: • A traffic analysis (on file) was performed and showed no impact. • Noise levels will fall below mandated levels for residents and surrounding properties. • Air quality guidance thresholds of the South Coast Air Quality Management District would not be tripped, and • A Preliminary Water Quality Management Plan has been approved. e. The site would be adequately served by all required utilities and public services in that all services exist to serve the site. RECOMMENDED ACTION: Adopt Planning Commission Resolution 18 -16 approving the construction of a new 40 unit, three story townhouse development. 2 Planning Commission September 19, 2016 I Discussion: Kelly Ribuffo, Associate Planner, presented a project overview consistent with the staff report. The Commission questioned staff about the noise element on Glassell Street and if the code requirements for residential development would address the noise concerns; if there had been any community contact with the City; and asked about the circulation pattern on Glassell Street. The applicants who were present for the project were Daryl Sequeira and Bryan Sevy. Mr. Sequeira, LaTerra Development, LLC, provided background on the company. He gave a PowerPoint presentation showing various aspects of the project. Mr. Sevy, KTGY Architecture, provided an overview of the site and discussed the architecture of the project. He thanked City staff for their help during the entitlement process. Commissioners Willits and Simpson disclosed that they had met with the applicant and were briefed on the project prior to the public hearing. The Commission asked the applicant about the location of the requested 20% reduction in setbacks; how the exterior lighting on the site and parking areas would be handled; how would the noise issue be addressed for the bedrooms facing Glassell Street; if there was an opportunity to strengthen the pedestrian access throughout the complex; if the downstairs bedroom was ADA compliant and if a buyer could option out the bedroom and make it into a tandem garage; and if there were any privacy concerns with the Riverbend development next to the proposed project. Public Hearing was opened. Alexander Lew, address on file, stated he was a resident at Riverbend. He had an issue with the architectural design and wanted more harmony between what is existing in the area and what was being proposed. He also was concerned that the outreach to his neighborhood was not done in a timely manner. Mr. Sequeira said when they bought the property in March 2015 that they had reached out to the community manager for the Riverbend development and explained the plans for the development and the manager was to share the information with the Riverbend board. Mr. Sevy explained that staff and the Design Review Committee steered them towards a more contemporary architecture. Public Hearing was closed. The Commission asked staff about the notices sent out to the Riverbend residents announcing the hearing, and clarified that the applicant had made contact with the 3 Planning Commission September 19, 2016 I property manager but not with the HOA. Public Hearing was opened. Mr. Lew said he did not receive a notice because he was outside the 300' radius. He said the notices went to a very small portion of the Riverbend residents and especially not the multifamily area. Public Hearing was closed. The Commissioners asked if there were mandatory design guidelines for Lincoln and Glassell; liked the architecture which would soften the view on Glassell; liked the right turn only access on Glassell which would afford less congestion; appreciated the resident coming to the meeting; suggested residents going to the management company because they are the ones that have to get the word out to the board; found the proposed project was compatible with the Riverbend townhouses directly behind the site; liked the design which could bring in more of a pedestrian connection; would like to see more of these developments in Orange; and pleased it would be ownership units. Motion was made to adopt Planning Commission Resolution 18 -16 approving Conditional Use Permit 2987 -15, Major Site Plan Review 0837 -15, Design Review 4821 -15, and Administrative Adjustment 0237 -15 for the construction of a new 40 unit, three -story townhouse development located at 2830 N.
