SR - RES-10969 - OCTA MEASURE M2 ENVIRONMENTAL CLEANUP PROGRAM TIER 1 GRANT APPLICATIONAGENDA ITEM September 13, 2016 1. SUBJECT Resolution No. 10969 — A Resolution of the City Council of the City of Orange authorizing an application for funds for the Environmental Cleanup, Tier 1 Grant Program under Orange County Local Transportation Ordinance No. 3 for installation of a Bio Clean Hydrodynamic Separator Unit and Connector Pipe Screens. 2. SUMMARY Resolution No. 10969 authorizes the City of Orange to apply for a $150,000 grant under the Orange County Transportation Authority's (OCTA) Measure M2 Environmental Cleanup Program Tier 1 Program. The total project cost is $200,000. 3. RECOMMENDED ACTION 1) Approve Resolution No. 10969, and authorize the Mayor to execute on behalf of the City. 2) Approve the submittal of one application for a Bio Clean Hydrodynamic Separator Unit and Connector Pipe Screens for the Environmental Cleanup, Tier 1 Grant Program under Orange County Local Transportation Ordinance No. 3. 4. FISCAL IMPACT The grant application requires a 25% match that has been budgeted in the following capital improvement fund: 220.5022.56340.15113 (Catch Basin Screening) $50,000 5. STRATEGIC PLAN GOALS 3. Enhance and promote quality of life in the community — b) Deliver high quality and safe, recreational, social, environmental, educational and cultural services. 16. GENERAL PLAN IMPLEMENTATION Natural Resources Elements Goal 2.0 Protect air, water, and energy resources from pollution and overuse. Policy 2.13: Control surface runoff water discharges into the storm water conveyance system to comply with the City's National Pollutant Discharge Elimination system (NPDES) Municipal Permit and other regional permits issued by the Santa Ana Regional Water Quality Control Board. Policy 2.16: Protect in- stream habitat and natural stream and channel features. 17. DISCUSSION and BACKGROUND I Renewed Measure M (M2) approved by the voters in 2006 is a 30 -year, multi - billion dollar program extension of the original Measure M (approved in 1990) with a new slate of planned projects and programs. These include improvements to the county freeway system, streets and roads network, expansion of the Metrolink system, more transit services for seniors and the disabled as well as funding for the cleanup of roadway storm water runoff. Orange County Local Transportation Ordinance No.3, dated July 24, 2006, is known and cited as the Renewed Measure M Transportation Ordinance and Investment Plan makes funds available through the Environmental Cleanup Program to help protect Orange County beaches and waterways from transportation - generated pollution (urban runoff) and improve overall water quality. In compliance with OCTA's application requirements staff prepared, and City Council approved, Resolution No. 10926 at its April meeting requesting Council authorization for application for funds. OCTA has since approved our project for funding but is now requiring additional clauses be added to the Resolution. The new clauses have been added to Resolution 10969 and state that the city will provide a minimum of 25% in matching funds for the project and include all projects funded by Net Revenues in the seven -year Capital Improvement Program. Due to OCTA's request, staff is recommending Council approve Resolution No. 10969 reflecting OCTA's additional clauses. 8. ATTACHMENTS • Resolution 10969 • Project location map RESOLUTION NO. 10969 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE AUTHORIZING AN APPLICATION FOR FUNDS FOR THE ENVIRONMENTAL CLEANUP, TIER 1 GRANT PROGRAM UNDER ORANGE COUNTY LOCAL TRANSPORTATION ORDINANCE NO. 3 FOR INSTALLATION OF A BIO CLEAN HYDRODYNAMIC SEPARATOR UNIT AND CONNECTOR PIPE SCREENS WHEREAS, the City of Orange (the "City ") is a municipal corporation, which exercises governmental functions and powers and is organized and existing under the laws of the State of California; and WHEREAS, Orange County Local Transportation Ordinance No. 3, dated July 24, 2006, and is known and cited as the Renewed Measure M Transportation Ordinance and Investment Plan makes funds available through the Environmental Cleanup Program to help protect Orange County beaches and waterways from transportation - generated pollution (urban runoff) and improve overall water quality; and WHEREAS, the Environmental Cleanup, Tier 1 Grant Program consists of funding purchases and installation to catch basins with Best Management Practices, such as screens, filters, inserts and other "street- scale" low flow diversion projects; and WHEREAS, Orange County Transportation Authority ( "OCTA ") has established the procedures and criteria for reviewing proposals; and WHEREAS, the City of Orange possesses authority to nominate water quality improvement projects that have transportation pollution nexus to finance and construct the proposed project; and WHEREAS, by formal action of City of Orange, City Council authorizes the nomination of the City of Orange Bio Clean Hydrodynamic Separator Unit and Connector Pipe Screens Installation Project, including all understanding and assurances contained therein, and authorizes the person identified as the official representative of the City of Orange to act in connection with the nomination and to provide such additional information as may be required; and WHEREAS, the City of Orange will maintain and operate the equipment acquired and installed; and Reso.
