SR - RES-10961 - RESCINDING LEVEL 1 AND 2 WATER ALERTSAGENDA ITEM 1. SUBJECT Resolution No. 10961 - A resolution of the City Council of the City of Orange rescinding the Level 1 and 2 -Water Alert -Water Supply Shortage as detailed in Ordinance 05 -14 Water Conservation and Water Supply Shortage Program and Regulations. 12. SUMMARY In response to improving water supply conditions, the City of Orange, as a water purveyor is able to rescind the Level 1 and 2 water conservation measures. 3. RECOMMENDED ACTION Adopt Resolution No. 10961 - A resolution of the City Council of the City of Orange rescinding the Level 1 and 2 -Water Alert-Water Supply Shortage as detailed in Ordinance 05 -14 Water Conservation and Water Supply Shortage Program and Regulations. 4. ITEM I • 1 1 08/9/16 6. GENERAL PLAN IMPLEMENTATION Infrastructure Element Goal 6.0: Ensure water, sewer, and storm drain systems meet the needs of residents and businesses. Policy 1.1: Provide sufficient levels of water, sewer, and storm drain service throughout the community. Economic Development Element Goal 6.0: Provide sufficient infrastructure to support anticipated economic development and growth. Policy 6.1: Provide public improvements to support commercial, industrial, and institutional uses. 7. DISCUSSION and BACKGROUND On January 17, 2014 in response to the ongoing severe drought conditions, Governor Brown declared a State of Emergency to exist throughout the State of California. He implored all Californians to reduce water usage by 20%. The Governor reaffirmed the proclamation on April 25, 2014. To implement reductions statewide, the State Water Resources Control Board ( SWRCB) enacted emergency regulations that were approved by the State of California Office of Administrative Law and went into effect on July 28, 2014. Over the following two years the Governor has issued Executive Orders (B- 26 -14, B- 28 -14, B- 29 -15, B -36 -15 and B- 37 -16) to further respond to the changing drought conditions. To comply with the Governor's orders and regulations, the City Council approved Ordinance 05- 14 which went into effect November 14, 2014. In summary, the ordinance called for the implementation of some permanent water restrictions and four levels of water conservation that could be implemented in the future if drought conditions persisted. In response to the State mandated 28% water conservation, the City Council approved Resolution No. 10865, which adopted the Level 1 and 2 — Water Alert — Water Supply Shortage as detailed in Ordinance 05- 14. This resolution implemented a maximum of two days per week of landscape irrigation from April to October and a maximum of one day per week during the months of November to March. Since the adoption of Ordinance 05 -14, and subsequent approval of Resolution 10865, Level 1 and 2 water use restrictions, water use in the City of Orange, along with most of the rest of the state, has been steadily declining. The overall state water conservation effort, along with the resulting winter rainfall, has resulted in a change in the water supply conditions across the state. The Governor's latest Executive Order, B- 37 -16, on May 13, 2016, recognized the change in water supply conditions and tasked the SWRCB to adjust emergency water conservation regulations through the end of January 2017. The new stance from the Governor has given water agencies some latitude to match water restrictions with the unique conditions each agency faces in dealing with and maintaining a dedicated water conservation effort that meets conservation goals moving forward. In June, ITEM 2 08/9/16 2016, staff in coordination with Municipal Water District of Orange County developed and submitted to the SWRCB the water conservation target level that indicated Orange as having sufficient water supplies to satisfy its demands. Therefore, the City indicated to the State that no water conservation target was needed. In rescinding the Level 1 and 2 — Water Alert — Water Supply Shortage, the components of Level 1 and 2 would be replaced with the permanent provisions of Ordinance 05 -14 and would remain in force and include the following: • Watering or irrigation of landscaping is prohibited between the hours of 9 a.m. and 5 p.m. • Watering or irrigation of landscaping is limited to no more than 15 minutes per day per station. • Washing down hard or paved surfaces such as driveways, streets, sidewalks, etc. is prohibited. • Watering or irrigation of landscaping in a manner that causes or allows excessive run -off onto driveways, streets, sidewalks, etc. is prohibited. • Using water to wash a vehicle is prohibited except by hand -held bucket or hand -held hose equipped with a positive self - closing water shut -off nozzle. • Obligation to fix leaks within 7 days. • Re- circulating water required for water fountains and decorative water features. Additionally, the irrigating of ornamental turf on public street medians is permanently prohibited by the SWRCB. The Resolution carries with it the implementation of a 10% water conservation goal for all residents, businesses, and visitors. While it is believed that with the passage of Resolution No. 10961 water consumption will continue to trend as it has over the past two years, staff will continue to closely monitor water consumption demand. If demand increases significantly or the Governor, through the SWRCB, implements new mandatory conservation goals, staff may recommend additional action to further reduce water demand. 8. He reported that the community will be informed of the modified drought regulations through various means including the City's website and social media.
