SR - RES-10952 - ACCEPT CERTAIN ROADS AND STREETS INTO CITY STREET SYSTEM1. SUBJECT Resolution No. 10952 — A Resolution of the City Council of the City of Orange accepting certain roads and streets into the City Street System. 2. SUMMARY Adoption of Resolution No. 10952 will cause certain real property previously acquired by the City for street purposes to be accepted into the City Street System. 3. RECOMMENDED ACTION Adopt Resolution No. 10952. 4. FISCAL IMPACT No fiscal impact. 5. STRATEGIC PLAN GOAL(S) Provide for a safe community. d. Assure the development of the City occurs in a fashion that maximizes public safety. 6. GENERAL PLAN IMPLEMENTATION Infrastructure Element Goal 3.0 Ensure adequate maintenance of public rights -of -way to enhance public safety and improve circulation. Policy 3.1: Continue to maintain and repair sidewalks and pavement surfaces on public rights - of -way. ITEM 3 -a) 1 7/12/16 7. BACKGROUND and DISCUSSION Section 1806 of the California Streets and Highways Code provides that, except upon the annexation of territory to the City, no public or private street or road shall become a City street or road until the City Council, by resolution, has caused the street or road to be accepted into the City Street System. A portion of a particular parcel (APN 374 - 341 -34), commonly known as Channel No. 5 and adjacent to Fletcher Elementary School on Fletcher Avenue is currently shown on the Assessor's maps as part of the street right -of -way. Without City Council action incorporating the portion (the southerly 20' of APN 374 - 341 -34) that is now street right -of -way, the Assessor will not change their map to reflect the current street configuration. This resolution will incorporate that street right -of -way into the City Street System, thus allowing the Assessor to correct the configuration on their maps. Although this parcel is owned by the City, the portion that is now a street right -of -way is not considered a public street until the City adopts a resolution to expressly accept that portion of the parcel into the City Street System, and only then it will be shown as a public street by the Orange County Assessor in the Assessor's map book. Upon the adoption of Resolution No. 10952 and recordation of a certified copy thereof in the Official Records of the County of Orange, the Assessor's map book will be revised by the County Assessor to correctly show that portion of the parcel that is a public street. 8. ATTACHMENTS • Resolution No. 10952 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE ACCEPTING CERTAIN ROADS AND STREETS INTO THE CITY STREET SYSTEM. WHEREAS, Section 1806 of the California Streets and Highways Code provides that, except upon the annexation of territory to the City, no public or private street or road shall become a City street or road until the City Council, by resolution, has caused the street or road to be accepted into the City street system; and WHEREAS, pursuant to Section 1806 of the California Streets and Highways Code, the City Council desires to accept the real property and /or parcel described as the Southerly 20' of Assessor's Parcel No. 374 - 341 -34, which is depicted on the map attached to this Resolution as Exhibit A , into the City street system. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Orange as follows: Section 1. Effective upon the date that a certified copy of this Resolution is recorded in the Official Records of the County of Orange, the real property and parcels described as the Southerly 20' of Assessor's Parcel No. 374 - 341 -34, which is depicted on the map attached to this Resolution as Exhibit A , into the City street system. Section 2. The City Clerk is hereby authorized and directed to cause a certified copy of this Resolution, attested by the City Clerk under seal, to be recorded without acknowledgement, certificate of acknowledgement, or further proof in the Official Records of the County of Orange. Section 3. All actions heretofore taken by the officers, employees and agents of the City with respect to the acceptance of conveyance and the recordation of any instrument relating to any and all of the real property and/or parcels described in Section 1 of this Resolution are hereby approved, confirmed and ratified, and the officers and employees of the City are hereby authorized and directed, jointly and severally, to do any and all things and to execute and deliver any and all certificates and documents which they may deem necessary or advisable in order to consummate the acceptance of said streets or roads into the City street system and otherwise to effectuate the purposes of this Resolution. SAORA -024 (SA1000.0) A Resolution of the governing board of the Successor Agency to the Orange Redevelopment Agency authorizing the execution and delivery of a purchase and sale agreement regarding the Successor Agency's sale of a property to Regents of the University of California and taking related actions. ACTION: Approved Resolution No. SAORA -024; and authorized the Chairperson, the Vice Chair, and the Executive Director to execute the Sale Agreement. REPORTS FROM MAYOR SMITH In light of the tragic events that happened in Dallas, Texas; Mayor Smith extended the City's heartfelt appreciation to the Orange Police Department and pledged the City's support to its Police Officers.
