SR - - CONFLICT OF INTEREST CODE BIENNIAL REVIEW1. SUBJECT City of Orange Conflict of Interest Code Biennial Review. 2. SUMMARY State law mandates that conflict of interest codes be reviewed each even - numbered year. As the code reviewing body for the City of Orange, the City Council must, no later than July 1, 2016, direct review of its code and, no later than October 1, 2016, receive notice that an amendment is or is not required. If an amendment is required, it must be completed prior to December 31, 2016. 3. RECOMMENDATION Direct staff to review the code and submit a notice to the City Council prior to October 1, 2016, that either an amendment is required or that no amendment is necessary. 4. FISCAL IMPACT None. 5. STRATEGIC PLAN GOAL(S) This action does not correlate to any of the adopted strategic plan goals; however, Section 87306 of the California Government Code requires biennial review of the City's Conflict of Interest Code. ITEM J -5 1 6/14/16 6. DISCUSSION and BACKGROUND The Political Reform Act requires every local government agency to adopt a Conflict of Interest Code (COI) and to review its code biennially to determine if it needs to be amended. The City of Orange COI was last amended in 2014. The Conflict of Interest Code identifies officials, employees, committees and commissions, and consultants who are required to file a Statement of Economic Interest Form 700 when assuming office, on an annual basis, and upon leaving office. Designated individuals must disqualify themselves when conflicts of interest occur. The City Council is the code reviewing body for the City of Orange. Therefore, per Government Code §87306.5, the City Council must, no later than July 1, 2016, direct review of its code. Upon receiving such direction, staff will evaluate and determine if any changes are necessary. The completed review must be submitted to the City Council, with any recommended changes, by October 1, 2016. If an amendment is required, it must be completed prior to December 31, 2016. 7. ATTACHMENT City of Orange Resolution No. 10817 with Exhibit A — List of Designated Employees and Disclosure Categories adopted on September 9, 2014 ITEM 1 6/14/16 RESOLUTION NO. 10817 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE ADOPTING THE BIENNIAL REVISIONS TO EMPLOYEE POSITIONS AND TITLES IN THE CONFLICT OF INTEREST CODE FOR THE CITY OF ORANGE. WHEREAS, the Political Reform Act, Government Code Sections 81000 et sue., requires the City to adopt and promulgate a conflict of interest code; and WHEREAS, the City has complied with this requirement by adopting by reference the model conflict of interest code developed by the Fair Political Practices Commission as the Conflict of Interest Code for the City of Orange; and WHEREAS, the Political Reform Act, in Government Code Section 87306, requires the City to review and revise as necessary, its Conflict of Interest Code every even - numbered year; and WHEREAS, the City has determined that due to changes in City employee positions and titles, the City's Conflict of Interest Code requires revision. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange as follows: 1. The list of designated employees required to file statements of economic interests is hereby amended to include those persons as set forth in Exhibit "A ", which is attached hereto and incorporated herein by this reference. 2. Only those persons who are designated in the City's Conflict of Interest Code for the first time are required to file an initial statement as defined in the City's Conflict of Interest Code.
