SR - AGR-6348 - LEFT TURN SIGNAL MODIFICATION TUSTIN STREET VANOWEN AVENUE1. SUBJECT Award of Contract - Bid No. 156 -33; Tustin Street and Vanowen Avenue Left Turn Signal Modification Project (SP- 3927). 2. SUMMARY Bids for the Tustin Street and Vanowen Avenue Left Turn Signal Modification Project were received, and opened on April 14, 2016. Six (6) bidders responded to the Notice Inviting Bids. The lowest bidder is Calpromax of Placentia, CA. However, Calpromax was determined to be non - responsive to the City's bid criteria. California Professional Engineering, Inc. of La Puente, CA is the apparent lowest bidder. 3. RECOMMENDED ACTION 1) Reject the bid received from the low bidder, Calpromax of Placentia, CA on the basis its bid proposal was not responsive to the City's invitation to bid; 2) Accept the next lowest bid, and award the contract to California Professional Engineering, Inc. in the amount of $355,156, and authorize the Mayor to execute on behalf of the City; and 3) Appropriate $95,000 from Fund 284 (TSIP B) to account number 284.5032.56100.20244 (Tustin St. and Vanowen Ave. Traffic Signal Modification). 4 FISCAL IMPACT Upon additional appropriation, funds will be available in the following account: 284.5032.56100.20244 Tustin/Vanowen Traffic Signal Modification $ 415,000 ITEM 3.32 1 5/10/2016 Printed on Recycled Paper 5. STRATEGIC PLAN GOAL(S) lb) Provide for a safe community — Provide and maintain infrastructure necessary to ensure the safety of the public. 3d) Enhance and promote quality of life in the community- Maintain and improve multi -modal transportation throughout the City. 16. GENERAL PLAN IMPLEMENTATION I Circulation & Mobility Goal 1.0 Provide a safe, efficient, and comprehensive circulation system that serves local needs, meets forecasted demands, and sustains quality of life in neighborhoods. Policy 1.2: Identify key intersections and streets with historical or projected traffic congestion problems and apply creative traffic management measures to improve overall circulation. Policy 1.6: Maintain and repair roadways and sidewalks as necessary to improve circulation and safety. 17. DISCUSSION and BACKGROUND The City Council approved authorization to advertise the project for construction bids on March 8, 2016. The solicitation for bids was advertised on March 23, 2016 for a period of three (3) weeks. Six bids were received and opened on April 14, 2016 as follows: 1) Calpromax Engr, Inc., La Puente ................ .......................$319,435 2) California Professional Engr., La Puente ...... ........................355,156 3) JFL Electric, Inc., Los Angeles, CA .............. ........................370,548 4) Asplundh Construction Corp., Anaheim ....... ........................399,585 5) DBX Inc., Temecula ....... ............................... ........................404,380 6) Elecnor Belco Electric, Inc., Chino ............... ........................406,610 Upon review of the bid proposal, staff has determined the bid from Calpromax Engr., Inc., (Calpromax) was non - responsive, and did not comply in all material respects to the City's invitation to bid. Section 2 -1.2 "Qualification of Bidders ", Item 7 of the bid specifications requires a bidder to have a minimum of five years experience in completing contracts of a similar nature to the project. A check with the Contractors State Licensing Board indicated Calpromax has held an Electrical (C -10) Class license since August 20, 2014, one (1) year and eight (8) months at the time of bid opening, which does not meet the five year experience requirement. Calpromax's three completed projects, two (2) for private property owners, and the City of Newport Beach are not similar in nature, type, size, and dollar amount with the project's bid solicitation. 2 C Printed on Recycled Paper California Professional Engr., Inc. (CPE) proposal, the second lowest bid, complies in all material respects to the bid solicitation. CPE has held an Electrical (C -10) license since April 2001. CPE has completed similar projects for various local agencies including Pasadena, Santa Ana, Anaheim, La Habra, and County of Los Angeles. CPE successfully completed projects for the City of Orange which are the Tustin St. and Palm Ave. Traffic Signal Modification, and Old Towne Street Lighting. Calpromax was notified of this determination and was advised that staff will recommend to the City Council the rejection of its bid, and award the contract to the second lowest bidder at the May 10, 2016 Council Meeting. During the design of the traffic signal, it was determined that repair work is required to the existing pavement, cross gutters and sidewalk located at the intersection. This additional work added cost to the bids, but is necessary to complete the project. The total estimated construction cost including contract, contingencies, and construction engineering is $400,000 while available funds are $305,000. Staff is requesting additional appropriation of $95,000 from unreserved 284 funds to cover the shortfall. The scope of traffic signal modification includes removal and replacement of controller and cabinet, signal poles and foundations, service, vehicular and pedestrian indications, detectors, pullboxes, pedestrian push- buttons, LED safety lighting fixtures, and street name signs; installation of emergency vehicle preemption, CCTV camera; and restoration of existing improvements. Civil works include removal and replacement of ADA compliant sidewalk access ramps, cross - gutter and spandrel, curb and gutter, and pavement sections on Vanowen. The project is categorically exempt from the provisions of the 2016 CEQA Guidelines under Article 19. "Categorical Exemptions ", Section 15301 "Existing Facilities ", classifies this project as Class 1 (c) "Existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities ". This categorical exemption applies to projects that involve minor alteration to an existing facility. The Notice of Exemption has been filed with the County of Orange. Construction is scheduled to start late July 2016, and expected to be completed in three months. 8.
