Americans with Disabilities Act (ADA) Wheelchair Access Ramps at Various Locations Project,
Fiscal Year 2015 -2016 (FY16).
1 2. SUMMARY
Seven (7) bids for CDBG ADA Wheelchair Access Ramps at Various Locations, FY16 were
received and opened on March 17, 2016. The apparent responsive low bidder is EBS General
Engineering, Inc. in the amount of $213,900.
3. RECOMMENDED ACTION
1. Reject the bid received from the first apparent low bidder, C.J. Concrete Construction, Inc., a
California Corporation, on the basis that the bid was not responsive.
2. Reject the bid received from the second apparent low bidder, S &H Civilworks, a California
Corporation, on the basis that the bid was not responsive.
3. Award the contract in the amount of $213,900 to EBS General Engineering, Inc. and authorize
the Mayor and City Clerk to execute the necessary documents on behalf of the City.
4. FISCAL IMPACT
Funds are budgeted and available in the Capital Improvement Program in the following account:

6. GENERAL PLAN IMPLEMENTATION
Infrastructure Element Goal 3.0 Ensure adequate maintenance of public right -of -way to enhance
public safety and improve circulation.
Policy 3.1: Continue to maintain and repair sidewalks and pavement surfaces on public right -of-
way.
7. DISCUSSION and BACKGROUND
The City Council previously approved advertisement for bids at its February 9, 2016 meeting. The
bid solicitation was advertised on February 17, 2016 for a period of two (2) weeks, and bids were
opened on March 17, 2016. Seven (7) bidders submitted proposals as follows:

Upon review of bids received, staff determined that CJ Concrete Construction, Inc. was not
responsive and did not conform in all material respects to the specifications contained in the City's
invitation to bid. Section "2 -1.3 Procedure for Proposal Submittal" of the City of Orange Special
Provisions required bidders to meet the DBE goal of 6 %, or show Good Faith Efforts. CJ Concrete
Construction, Inc. did not meet the required DBE commitment nor did they show Good Faith
Efforts as outlined in the specifications and do not qualify as a responsive bidder.
S &H Civilworks was the apparent second lowest bidder. Upon review of their bid, staff has
determined that it was not responsive to and did not conform in all material respects to the
specifications contained in the City's invitation to bid. Section "2 -1.2 Qualifications of Bidders"
of the City of Orange Special Provisions required bidders to have a minimum of five (5) years'
experience in completing contracts of a similar nature. The Contractors' State License Board
shows that S &H Civilworks has held a Class A license for less than 5 years at the time of bid
submittal, meaning that S &H Civilworks did not meet the minimum work experience required to
qualify as a responsive bidder.
EBS General Engineering, Inc. is the apparent responsive low bidder. This contractor has
performed several project for the City of Orange. All projects were completed within project
specifications and on schedule. Therefore, staff recommends that EBS General Engineering, Inc.
be awarded the contract in the amount of $213,900 for the CDBG ADA Wheelchair Access Ramps
at Various Locations Project (FYI 6).
This project will provide for construction of approximately fifty ADA wheelchair access ramps at
the locations depicted on the attached location map. As part of this project, detectable warning

surfaces (truncated domes) will be installed per the American with Disabilities Act Accessibility
Guidelines (ADAAG) requirements.
The City receives CDBG funding from the U.S. Department of Housing and Urban Development
for activities that primarily benefit Low and Moderate Income residents. Construction of ADA
compliant access ramps qualifies for CDBG funding because the ramps benefit disabled residents
that are considered to be Low Income.
The estimated total cost for this project is $250,000 including 15% contingency and construction
engineering.
Construction is scheduled to begin in early May 2016, and is expected to be completed within two
months.

NOTICE IS HEREBY GIVEN that work on that certain public work and improvements known as "CDBG ADA
Wheelchair Access Ramps at Various Locations FY 2015 -2016 (Bid No. 156 -28, SP- 3943)" (herein referred to as the
"Project "), for the owner, the City of Orange, a municipal corporation (herein referred to as the "City "), whose address
is 300 E. Chapman Avenue, Orange, CA 92866, was completed and accepted by the City Council of the City of Orange
on July 12, 2016 at a regular meeting of its members, at which a quorum was present and acting throughout. The
Project is at various locations in the City of Orange, State of California. The contractor who performed (or caused to
be performed) said public work and improvements was EBS General Engineering, Inc., a California corporation, with
its principal office at 1320 E. Sixth Street Suite 100 in the City of Corona, State of California 92879.
The name of the surety on the Labor and Material Bond for the Project is Suretec Insurance Company State of Texas
(Bond No. 4405770) in the amount of $213,900.00.
