SUBJECT: _771 Agreement for the transfer of ownership of the Police Service Dog, Lycan, assigned to the Police Department's Canine Team, from the City of Orange to Canine Officer Carlos Gutierrez. 2. `SUMMARY: Canine Officer Carlos Gutierrez has been assigned to the Police Department's Canine Team for the past seven with Lycan as his canine partner. K9 Lycan's last day of service was February 22, 2016 and it is the Police Department's recommendation that his ownership be transferred from the City of Orange to Officer Carlos Gutierrez. 3. RECOMMENDATION: Approve the Agreement transferring ownership of Lycan to Officer Carlos Gutierrez, effective February 23, 2016. 4. FISCAL IMPACT There will be no fiscal impact to the General Fund. 5. DISCUSSION and BACKGROUND Lycan has served the Orange Police Department Canine Team for seven years with Officer Carlos Gutierrez as his handler. As Lycan has been trained to aid in the apprehension of criminal suspects he could be dangerous to others if not placed in the care of a trainer. For the safety of Lycan and the public, it is preferable that he remains in the hands of the person and family that have been providing his care and training. The Department recommends the transfer of ownership of Lycan from the City of Orange to Officer Carlos Gutierrez. The transfer of ownership agreement with Officer Gutierrez requires him to indemnify and defend the City for any injuries or property damage arising out of the conduct of Lycan. It is the Department's recommendation that this arrangement with Officer Gutierrez will benefit to the City by reducing the City's liability exposure and relieving the City of the responsibility for the care and feeding of Lycan. 8.
