SUBJECT Agreements between (1) City of Orange and City of Anaheim and (2) City of Orange and The Olson Company for Orange to provide sewer service to a new condominium development in Anaheim. 2. SUMMARY An Olson Company condominium development in City of Anaheim desires to connect to City of Orange sewer system. The condo project is located immediately north of City of Orange boundary on Manchester Avenue and Anaheim does not have a public sewer system that can practically serve this development. 3. RECOMMENDED ACTION Approve two sewer agreements: (1) Out of Area Sewer Service Agreement between City of Orange and City of Anaheim to allow the sewer discharge for property at 2337 -2415 South Manchester Avenue, Anaheim, to be served by City of Orange; and (2) Sewer Payment Agreement between City of Orange and The Olson Company for a lump sum payment of sewer maintenance fee. 4. FISCAL IMPACT Sewer maintenance fee will be paid by the developer, The Olson Company, to cover the cost for City of Orange to maintain the sewer main line. 5. STRATEGIC PLAN GOAL(S) 3c. GENERAL PLAN IMPLEMENTATION Land Use Element Goal 1.0 Meet the present and future needs of all residential and business sectors with a diverse and balanced mix of land uses. Policy 1.4: Ensure that new development reflects existing design standards, qualities, and features that are in context with nearby development. Policy 1.6: Minimize effects of new development on the privacy and character of surrounding neighborhoods. 7. DISCUSSION and BACKGROUND The Olson Company plans to develop a 120 -unit condominium at 2337 -2415 South Manchester Avenue in the City of Anaheim immediately north of the Orange /Anaheim city boundary, at northwest of Compton Avenue and Manchester Avenue. The land is currently a portion of the Ponderosa Mobile & R.V. Park property that is to be acquired by The Olson Company. The City of Anaheim does not have a public sewer system on South Manchester Avenue to serve this development. The landform in this area slopes generally in the southwesterly direction. Therefore, natural gravity flow for the sewer pipelines is toward the south and west. This landform makes it difficult for Anaheim to construct a sewer line to flow northward along South Manchester Avenue. The most natural way is for this development to drain sewer southerly into City of Orange. City of Anaheim and The Olson Company had requested City of Orange to allow this development to connect to City of Orange sewer system. City of Orange is able and is willing to accept the sewer and to allow connection to the sewer mainline at the corner of Compton Avenue and Manchester Avenue. City of Anaheim is willing to allow City of Orange to collect sewer maintenance fee from the development. The Olson Company is willing to pay sewer maintenance fee to City of Orange. A private sewer lateral will be constructed by The Olson Company from the development to City of Orange main line on Compton Avenue at a point approximately 100 feet west of Manchester Avenue intersection. The construction will be made and paid by the developer. A City of Orange Encroachment Permit will be issued to oversee this construction. The out -of -area sewer service is covered by two sewer agreements. One agreement is between City of Orange and City of Anaheim for the exchange of sewer service. Another agreement is between City of Orange and The Olson Company for the sewer maintenance fee payment. S.
