SR - AGR-6271 - METROLINK PARKING STRUCTURE STATE FUNDED TRANSIT PROJECTS1. SUBJECT Resolution No. 10891 — A Resolution of the City Council of the City of Orange authorizing the execution of a Master Agreement and Program Supplements for State - funded Transit Projects. 2. SUMMARY The City of Orange will be requesting a funding allocation through the California Department of Transportation for the Metrolink Parking Structure project. In order for the City to administer projects and receive State funds for use on local transit related projects such as the Metrolink Parking Structure, it must enter into a Master Agreement with the State through the State of California Department of Transportation (Caltrans). 3. RECOMMENDATION Adopt Resolution No. 10891. 4. FISCAL IMPACT There will be no direct impact on the City's General Fund. 5. STRATEGIC PLAN GOAL(S) 1. Provide for a safe community b. GENERAL PLAN IMPLEMENTATION Economic Development Goal 2.0: Cultivate a business environment that is conducive and appealing to the commercial and retail industry, including smaller entrepreneurs. Policy 2.4: Maintain adequate infrastructure, transportation systems, and physical conditions that encourage retailers to invest in the City. 7. DISCUSSION and BACKGROUND Construction funding for the Metrolink Parking Structure project will be funded in part with State Transportation Improvement Programs funds (STIP) in the amount of $13.762 million. In order for the City to administer projects and receive these State funds for use on local transit related projects, it must enter into a Master Agreement with the State through the State of California Department of Transportation ( Caltrans). Master Agreements are general in nature and intended to provide the basic groundwork for future State - funded allocations on specific projects. Once the specific project is ready to proceed, Caltrans will prepare a Project Supplement Agreement for the project, which is then executed by the City Manager or the Director of Public Works in order for the City to receive reimbursement for expenditures. It is recommended that the City Council approval Resolution No. 10891 approving the Master Agreement for State - Funded Transit Projects with Caltrans. 8. ATTACHMENTS • Resolution No. 10891 • Master Agreement N: \Economic Development Files \STAFF REPORTS\2015 \101315c_Master Agreement. doe ITEM 2 10/13/15 RESOLUTION NO. 10891 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE AUTHORIZING THE EXECUTION OF A MASTER AGREEMENT AND PROGRAM SUPPLEMENTS FOR STATE - FUNDED TRANSIT PROJECTS WHEREAS, the City of Orange may receive state funding from the California Department of Transportation (Department) now or sometime in the future for transit projects; and WHEREAS, substantial revisions were made to the programming and funding process for the transportation projects programmed in the State Transportation Improvement Program, by Chapter 622 (SB 45) of the Statutes of 1997; and WHEREAS, the statutes related to state - funded transit projects require a local or regional implementing agency to execute an agreement with the Department before it can be reimbursed for project expenditures; and WHEREAS, the Department utilizes Master Agreements for State - Funded Transit Projects, along with associated Program Supplements, for the purpose of administering and reimbursing state transit funds to local agencies; and WHERERAS, the City Council desire to save time and work by authorizing the City Manager or the City's Director of Public Works to execute any and all Program Supplement Agreements and such other documentation as they may deem necessary and appropriate in connection with the New Master Agreement for State - Funded Transit Projects. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange as follows: Section 1. Approval of New Master Agreement. The terms and provisions of the New Master Agreement between the City of Orange and Department in substantially the form submitted by the City Manager are approved. The City of Orange agrees to comply with all conditions and requirements set forth in this agreement and applicable statutes, regulations and guidelines for all state - funded transit projects. Section 2. Authorization for Officers to Act. The City Council hereby authorizes and directs the City Manager or the Director of Public Works or their designee, to execute on behalf of the City the New Master Agreement and all Program Supplement Agreements as they occur under the New Master Agreement and do any and all things and take any and all actions necessary to execute any and all documents, which they, or any of them, may deem necessary or advisable and take any and all action deemed by any of them to be proper in connection with the New Master Agreement and all Program Supplements for State - Funded Transit Projects and any Amendments thereto with the California Department of Transportation.
