Gustafson Chief of Police Admin Reports Plan /Environ 1 1. SUBJECT FY 2015 Edward Byrne Memorial Justice Assistance Grant (JAG) for the purchase of mobile phone forensic hardware and software. 2. SUMMARY The U.S. Department of Justice has made funds available under the FY 2015 JAG Program. As in past years, all Orange County cities and the County have submitted a joint application. The total joint award amount is $365,772 of which the City of Orange will receive $11,317. The County of Orange is requesting approval of an agreement that allocates the City's 2015 JAG funds as follows: $1,018 for grant administrative fees to the County with $10,299 retained by the Citv to purchase mobile phone forensic hardware and software. 13. RECOMMENDATION 1. Authorize the City Manager or his designee to execute the agreement between the City and the County of Orange for $11,317 in FY 2015 JAG funds, including the allocation to the County. 2. Accept into the City's revenue budget $10,299 from the County of Orange into revenue account number 353.4011.45150.30008, Federal Grants -2015 JAG. 3. Appropriate $10,299 from account 353.4011.45150.30008, Federal Grants -2015 JAG, to account 353.4031.55131.30008, Federal Grants- Equipment -2015 JAG, for the purchase of mobile phone forensic hardware and software. 4. Authorize the purchase of mobile phone forensic hardware and software from Cellebrite, Inc. in the amount of $14,847 (note that existing funds are available in account 356.4011.55131.30008 State Asset Forfeiture -2015 JAG to cover the remaining $4,548. 4. Policy 6.1: Provide the Police Department with adequate personnel, equipment and state -of the art- technology to effectively combat crime, meet existing and projected service demands, and provide crime prevention programs. These resources should be provided prior to anticipated needs. 7. DISCUSSION and BACKGROUND During 2014, Orange Police Department investigated thousands of crimes, a majority of which directly or indirectly involved a cellular phone. The investigations discovered the suspects /victims use and /or possession of cellular phones during the commission of crimes or when being victimized. Cellular phones contain minute by minute digital evidence of a suspect and /or victim's location and communication before, during and after the commission of a crime. The timely retrieval of this evidence in some cases may be lifesaving and be the only link that helps detectives solve the crime or locate the victim. By obtaining sophisticated cellular phone forensic extraction hardware and software, the Orange Police Department will be able to investigate technologically complex investigations. In addition, cellular phones are frequently used by suspects to store evidence of criminal activity or victimization. This equipment will also assist in the prosecution of suspects using evidence that simply could not be obtained by traditional methods. Due to the prevalence of cellular phones in our society, the Orange Police Department needs to obtain sophisticated cellular phone forensic extraction hardware and software in order to improve investigative effectiveness as technological advances increase. There have been times that physical evidence is complimented and strengthened by digital evidence. On occasion, digital evidence is all that exists to provide investigative leads and evidence in solving crimes. Public Law 109 -162 is the funding authority for the federal Department of Justice JAG Program. As in past years, all Orange County cities and the County have submitted a joint application.
