SUBJECT Amendment No. 1 to Cooperative Agreement No. C -9 -0901 between the Successor Agency to the Orange Redevelopment Agency (Successor Agency), the City of Orange (City) and the Orange County Transportation Authority (OCTA) for expansion of parking capacity at the Orange Santa Fe Depot. 2. SUMMARY This amendment extends the timeline for completion of the design phase of the Metrolink Parking Structure Project from December 31, 2015 to December 31, 2017. 13. RECOMMENDATION Authorize the Executive Director to approve and execute an Amendment No. 1 to Cooperative Agreement No. C -9 -0901 substantially in the form presented, and to administer the Successor Agency's obligations, responsibilities and duties to be performed under the Amendment No. 1. 4. FISCAL IMPACT This Amendment No. 1 only extends the timeline for design phase completion and has no fiscal impact. 5. STRATEGIC PLAN GO 2. Be a fiscally healthy community d. GENERAL PLAN IMPLEMENTATION Land Use (LU) Element 5.0 - Maintain and enhance the vibrant, transit - accessible, pedestrian friendly, and livable character of Old Towne's neighborhoods and commercial core. LU Policy 5.4 Develop additional sensitively designed public parking in Old Towne. Circulation and Mobility (CM) Element Policy 5.1 — Provide adequate parking to protect and support the economic vitality and diversity of Old Towne. CM Policy 3.1 — Work with OCTA and other agencies to assess City public transportation needs and to ensure delivery of services when and where they are needed. 7. DISCUSSION and BACKGROUND 71 California Health and Safety Code Section 34177 (i) authorizes the continued oversight of development of properties until the contracted work has been completed or the contractual obligations can be transferred to other parties. This Cooperative Agreement No. C -9 -0901 provides for reimbursement by Orange County Transportation Authority (OCTA) of the design costs for the project, including project management during the design phase, preparation of conceptual designs, community outreach, and preparation of plans and specifications for the two parking structure projects. The total estimated cost of the design phase of the Metrolink Parking Structures Project is $2,260,000. The Cooperative Agreement provides for reimbursement by OCTA for 73% (up to $1,650,000) of the design costs for the project including project management during the design phase. The remaining $610,000 is the former redevelopment agency's share of the cost for the design phase. This Cooperative Agreement is due to expire on December 31, 2015 As a result of delays in completion of the design phase caused by redevelopment dissolution efforts, an additional time extension is necessary at this time. It is anticipated that the design work will be completed within the next four months plus 20 months for design oversight during project bidding and construction. An Amendment for a two -year extension to December 31, 2017 is requested to allow sufficient time to complete the scope of work and submit for reimbursement by OCTA. There are no changes to the amount or other terms of the original agreement. A companion item is on the agenda for tonight's meeting of the Orange City Council. 8.
