SUMMARY KTGY Group, Inc., (KTGY) acting as a consultant to Chapman University, is requesting a dirt- hauling permit to allow the export of approximately 76,000 cubic yards of earth material from the Chapman University Center for Science and Technology site on the west side of Center St. between Sycamore Ave. and Walnut Ave. 3. RECOMMENDED ACTION Approve issuance of a dirt- hauling permit for the project, located on the west side of Center St. between Sycamore Ave. and Walnut Ave., subject to the conditions recommended by staff. 4. FISCAL IMPACT Will generate $960.00 revenue in permit fees. 5. STRATEGIC PLAN GOAL(S) 7= Ld Assure the development of the City occurs in a fashion that maximizes public safety. 6. DISCUSSION and BACKGROUND Chapman University is completing their construction plans to build the Center for Science and Technology addition to the campus. The project encompasses the redevelopment of the west side of Center St. from Sycamore Ave to Walnut Ave. and requires removal of the existing tennis courts, parking lot, and landscaping. This site will be reconstructed with a new two -level underground parking structure topped by a new academic facility, the Center for Science and Technology. The proposed underground parking structure is designed as an extension of the existing Lastinger parking structure located below the sports complex. An excavation approximately 140 feet wide by 560 feet long and 26 feet deep is required to build the parking structure extension, resulting in the removal of 76,000 cubic yards of earth material. The excavated earth material will be exported from the site over a five (5) month period of time, which may be extended to account for unforeseen events, such as rain or inclement weather. The University will begin the excavation work once the grading permit has been issued by the Public Works Department and the construction contract has been bid and awarded, estimated Spring of 2016. Walnut Ave. at Center Street, is a signalized intersection with one lane eastbound and one lane westbound and left turn pockets. Center Street is the northbound and southbound directions with one lane on each direction, and no left turn pockets. The north leg of Center Street leads to the residential units of Chapman University. The City and Chapman University both recognize the heavy pedestrian use of the intersection and the immediate vicinity. To enhance pedestrian safety during hauling operations, the existing crosswalk at the east leg of the intersection will be temporarily removed and the pedestrian traffic redirected to cross Walnut Avenue further west and away from the active construction area. Temporary traffic control plans for both vehicles and pedestrians will be in place during the entire hauling operation, and replaced upon completion. Pursuant to Section 10.67.030 of the City Municipal Code, a haul permit for the import or export of earth material in excess of 30,000 cubic yards requires City Council approval. In concert with the Commercial Vehicle Enforcement Detail of the Orange Police Department, Traffic Engineering recommends the imposition of the following conditions: 1) The initial number of trucks per day shall not exceed forty (40) subject to an increase to a maximum of sixty (60) trucks upon approval of the City Traffic Engineer. 2) A cash bond may be required to insure against loss of pavement life along primary haul routes. 3) No storage or queuing of haul trucks will occur on city streets or on the freeways. The staging area and the excavation on -site will be large enough to accommodate all of the 2 trucks queuing for the dirt. Hauling trucks will be retained at the grading contractor's site(s) and released via telecommunications. 4) The haul route shall be the following: 4.1) Exit the SR -91 Freeway at N. Glassell Street, travel southbound to Walnut Avenue, eastbound to the jobsite. Enter excavation from Walnut Avenue. Exit jobsite onto N. Center Street, then northbound back to Walnut Avenue, westbound on Walnut Avenue, then north on N. Glassell Street to SR -91 Freeway. 4.2) Exit the SR -57 Freeway at Katella Avenue, travel eastbound to N. Glassell Street, southbound to Walnut Avenue, eastbound to the jobsite. Enter excavation from Walnut Avenue. Exit jobsite onto N. Center Street, then northbound back to Walnut Avenue, westbound on Walnut Avenue, then north on Glassell Street and westbound on Katella Avenue to SR -57. 5) Additional route(s) may be necessary on availability of dump sites. Any such route shall be authorized only when approved by the City Traffic Engineer, and when an appropriate Rider to the Transportation Permit is obtained. 6) The sidewalks on the north side of Walnut Ave. between Grand St. and Center St., and west side of Center St. between Sycamore Ave. and Walnut Ave. adjacent to the project site shall be closed throughout the construction period. Appropriate SIDEWALK CLOSED signs shall be installed and maintained by the Contractor. Sidewalk shall be reopened at completion of the project in a condition deemed acceptable by the City Engineer. 7) The existing pavement on Glassell St., Walnut Ave., and Center St., along the haul route shall be tested, pavement condition assessed, and approved by the City Engineer, prior to the start of hauling operations, and prior to any route changes, and again upon completion. Any sections of pavement found to have deteriorated will be repaired or replaced, by Chapman University at the City's direction. Specific pavement testing will be as directed by the City Engineer. A copy of the study shall be provided to the City prior to issuance of the haul permit. 8) Contractor shall temporarily fix any potholes that may occur along the approved truck routes, using a hot -patch method; cold patch will not be acceptable. 9) Hours of hauling operations shall be from 9:00 A.M. to 3:30 P.M., Monday through Friday, (excluding Holidays). Contractor is advised that on -site construction may be allowed in accordance with Section 8.24.070 of the Orange Municipal Code regarding Noise Abatement, to work on -site from 7:00 A.M. through 4:00 P.M. with the following provisos. No employees or agent of the Contractor shall start engines of any construction equipment or trucks working on the project site prior to 7:00 A.M. under any circumstances. No trucks may be parked on city streets adjacent to the jobsite with motors running prior to 7:00 A.M. when on -site work may commence, including personal vehicles belonging to your employees, and employees of any subcontractor. 3 10) Duration of the haul permit shall be five (5) months from date of issuance which may be extended by the Public Works Director or designee to account for unforeseen events. 11) Contractor shall submit a traffic management plan including vehicular and pedestrian temporary traffic control plan for review and approval of the City prior to commencement of hauling operations. A flagman shall be provided at the ingress and egress to the work site on Walnut Ave. and Center St. Advance warning signing and safety devices as approved by the City Traffic Engineer shall be in place at all times during traffic control by flagmen. The flagman shall be on duty to control traffic at all times when hauling activity is in progress. Traffic control plan shall show temporary modification of pavement markings (including crosswalk), and modification to existing traffic signal to temporarily disengage pedestrian signal devices at the intersection. At that time during the hauling operations when exiting southbound onto Center St. becomes necessary, Contractor shall be required to install temporary barriers (K -rail or equivalent) along the parking lane on the west side of Center St. from Sycamore Ave. to Walnut Ave. 12) The Contractor shall provide street sweeping during each haul day on those streets utilized in the haul route. Sweeping shall occur as necessary throughout the working day and shall not wait to be performed at the end of the day, as directed by the City. A vacuum truck may be required for clean-up and compliance with the Storm Drain Act, at the discretion of the City. Additional sweeping by City forces, if necessary, will be billed to the Contractor and the haul permit shall be suspended until resolution of any sweeping problems. Construction site must be swept and washed clean at the end of each workday as noted in Section 7 -10, "Public Convenience and Safety" of the City of Orange Standard Specifications. 13) The Contractor will post a $5,000.00 clean-up deposit to guarantee that the street shall remain clean. 14) Haul route streets shall be washed every working day at the discretion of the City. Contractor shall provide a gravel bed and shaker bar, and shall wash off wheels and undercarriage of exiting vehicles prior to entering city streets to avoid tracking dirt and mud onto city roadways. A water truck may be required for dust control on the jobsite at the sole discretion of the City Inspectors. Water Quality Management Plan (WQMP) will be required and all requirements of same shall be adhered to. 15) As a result of the BIT Legislation (Bi- Annual Inspection of Commercial Vehicles, Drivers and Facilities) the vehicle safety inspections formerly required are not necessary. The Orange Police Department will, however, perform spot checks during the entire duration of this permit. 16) Violation of any condition of the haul permit or applicable sections of the State of California Vehicle Code by the Contractor or his subcontractors shall be cause, upon notification to the Contractor, for immediate suspension or revocation of the haul permit. 17) A responsible agent of the Contractor be identified and will be available to respond to Police and Public Works officials concerns, or inquiries at any time. 18) That the OPD Commercial Enforcement Detail, or the City Engineer will determine when wind conditions are of a magnitude requiring cessation of hauling activities for that day. To accommodate vehicles en- route, hauling will cease one (1) hour after the decision to cease has been made. 19) All loads of earth material shall be filled below the top of the sideboard, as outlined in the California Vehicle Code, or the loads shall be covered by a tarpaulin, as provided in the City Municipal Code, Ordinance 10.67, Section 10.67.030, Paragraph A.2, which states as follows: "Trailers carrying loads of earth material shall, in a manner adequate to prevent the earth material from blowing or bouncing out of or otherwise leaving the truck and/or trailer while traveling or standing upon any public roadway, either wet down the loads or cover the load of earth material with a tarpaulin prior to entering upon any public roadway in the City of Orange." 20) Permit is VOID if these conditions are not attached. A copy of this permit, with conditions, must be maintained in the cab of the truck at all times it is operating on city streets. It shall be the Contractor's responsibility to obtain necessary permits, distribute to sub - contractors and Contractor shall not be relieved of any fees associated with said permits. It shall be the Contractor's responsibility to maintain control of his sub - contractors and advise them of the conditions of the haul permit. Contractor shall agree to take corrective and disciplinary action against those who violate the rules and regulations established by this Permit. City Council approval of this request does not relieve Contractor of its responsibility to secure haul permits from the Public Works Department. 8. (P1300.0) Discussion — City Traffic Engineer Jacki Scott provided a brief staff report and answered Councilmember Alvarez's questions regarding the path the trucks will take and their schedule in areas where there have been automobile and pedestrian accidents in the past. City Traffic Engineer Scott stated that trucks will be staggered and limited during certain hours; and staff will monitor and enforce the conditions of the permit. Staff will also reach out to area schools to ensure there are no conflicts with the truck schedules and the time that students get out of school. Ken Ryan, KGTY Group, answered Councilmember Alvarez's questions regarding traffic safety. He assured Council that all drivers and foremen will be made aware of any safety issues. MINUTE ORDER — Councilmember Alvarez: "The reason I abstained on this item is that at this point, I can't vote yes or no on it. I attended that scoping meeting and it's probably for the first time that it seems as though Chapman is not reaching out, the way I would like to see it, to the neighborhoods that are being impacted either by the students or the traffic or the construction. And right now, I think that by doing this, in my mind, I hope that somebody in the higher echelons of Chapman University will see that there is one councilman that, for the first time in my first eight years in office and now my next three, can't really support what they're doing at this time." *NOTE — The City Attorney explained that Councilmember Alvarez's abstention is officially recorded as a "Yes" vote.
