2. SUMMARY
The following claim(s) have been received and investigated by the City Attorney's Office
and/or the Risk Manager. After a thorough investigation with the involved departments, it is the
recommendation of the City Attorney's Office that the claim(s) be denied:
a. Juan Carlos Ortega Espana
b. Lynn Leon, Jennifer Leon, Valerie Leon, V.L. (a minor), A.L. (a minor) and
Dominic Leon
c. Sergio Vargas- Ludwig
d. Mercury Insurance Company subrogee for James ODay

3. RECOMMENDATION
Deny claim(s) and refer to City Attorney and Claims Adjuster.

7. DISCUSSION and BACKGROUND
a. Claim for damages from Juan Carlos Ortega Espana alleging personal injury after he
tripped and fell while walking through a construction site occurring outside of City
boundaries.
b. Claim for damages from Lynn Leon, Jennifer Leon, Valerie Leon, V.L. (a minor),
A.L. (a minor) and Dominic Leon alleging wrongful death a result of being deprived
lifesaving medical attention.
c. Claim for damages from Sergio Vargas- Ludwig alleging personal injury after a fall
from the Katella bridge.
d. Claim for damages from Mercury Insurance Company subrogee for James Oday
alleging water loss at a property located outside of the City of Orange.
e. Claim for damages from Greg Cicero alleging property damage to his plumbing
caused by tree roots.
f. Claim for damages from Gustave Kuhlmann alleging personal injury when he tripped
and fell over a raised portion of sidewalk.
