The bill transferred responsibility for the incarceration, treatment and supervision of specified adult felons from the California Department of Corrections and Rehabilitation (CDCR) to each county under the Post - release Community Supervision (PCS) program. AB 109 contains a budget to fund overtime services for local agencies to assist counties with case management of these offenders. 2. SUMMARY The County Board of Supervisors, at its October 22, 2013 meeting, approved the Master Memorandum of Understanding (MOU) format to be used by the Chief Probation Officer to enter into individual agreements with the cities to reimburse overtime costs for law enforcement services to achieve the objectives of AB 109. The Board also authorized the Chief Probation Officer to renew the individual MOUs for succeeding 12 -month periods of July 1 through June 30. 3. RECOMMENDATION 1. Authorize the Mayor to execute the MOU between the City and the County of Orange for Public Safety Realignment and Post - release Community Supervision Cost Reimbursement to Local Law Enforcement Agencies for Enhanced Services and Other Authorized Expenditures. 2. Accept into the City's revenue budget a $26,569.34 funding allocation from the County of Orange into revenue account number 100.4021.45495.20159, General Fund - Post - release Community Supervision. 3. Authorize the appropriation of $26,569.34 into expenditure account 100.4021.50221.20159, General Fund - Post - release Community Supervision. 14. STRATEGIC PLAN GOAL(S) la. Provide for a Safe Community Provide staffing and resources to deliver services that ensure public safety. 6. GENERAL PLAN IMPLEMENTATION Public Safety Goal 6.0 Provide public safety services of the highest quality. Policy 6.1: Provide the Police Department with adequate personnel, equipment and state -of the art- technology to effectively combat crime, meet existing and projected service demands, and provide crime prevention programs. These resources should be provided prior to anticipated needs. 7. DISCUSSION and BACKGROUND Assembly Bill 109, the 2011 Public Safety Realignment Act, was implemented on Octoberl, 2011. The bill transferred responsibility for the incarceration, treatment and supervision of specified adult felons from the California Department of Corrections and Rehabilitation (CDCR) to each county under the Post - release Community Supervision (PCS) program. Inmates eligible for release to local jurisdictions for supervision under PCS must be: • Currently incarcerated for non - violent and non - serious offenses; • Released on parole and non - revocable parole; and • Are not high -risk sex offenders. At full implementation, it is estimated that 3,434 offenders will be supervised in Orange County. Due to the increase of PCS individuals in Orange, the Police Department is working closely with Orange County Probation to help manage these offenders. Orange County Probation has offered their support with both manpower and financial resources. The objective is to closely monitor these individuals by conducting four PCS sweeps during FYI 5. Each sweep will last four hours and have three sergeants and twelve detectives assigned for each. Each sweep will cost approximately $4,428 for a total of $26,569.34 for the fiscal year. 8.
