SUBJECT Resolution No. 10819 — A Resolution of the City Council of the City of Orange approving the submittal of transportation improvement projects to the Orange County Transportation Authority (OCTA) for funding under the Arterial Pavement Management Program Funded with Regional Surface Transportation Program under the Moving Ahead for Progress in the 21 Century Federal Transportation Act. 2. SUMMARY Resolution No. 10819 is required to be adopted as part of the application package for the Arterial Pavement Management Program request for project applications. 3. RECOMMENDED ACTION 1) Approve Resolution No. 10819, and authorize the Mayor to execute on behalf of the City. 2) Approve the submittal of the two (2) proposed transportation improvement projects to the Arterial Pavement Management Program for Fiscal Years 2015/16 as administered by OCTA. 4. FISCAL IMPACT No impact on budget. 5. STRATEGIC PLAN GOALS 1 b. Provide for a safe community — Provide and maintain infrastructure necessary to ensure the safety of the public. 3d. GENERAL PLAN IMPLEMENTATION Growth Management Element Goal 2.0 Provide for adequate regional and local transportation facilities. Policy 2.1: cooperate with other agencies to address regional issues and opportunities related to growth, transportation, infrastructure, and other planning issues. 7. DISCUSSION and BACKGROUND The Arterial Pavement Management (APM) Program funded with Regional Surface Transportation Program (RSTP) under the Moving Ahead for Progress in the 21 st Century Federal Transportation Act has been developed to address pavement maintenance in Orange County. This program seeks to provide cost - effective treatments that will preserve or improve the functional pavement condition and extend the service life for distressed arterials in the County of eligible projects on the Master Plan of Arterial Highway. There will be approximately $20 million in federal RSTP available for projects in fiscal year 2015 -16 with a maximum grant amount of $500,000 /project. Applicants must provide 50% matching funds for each candidate project. The Public Works Department has identified two projects in need of rehabilitation that meet the minimum criteria for the APM Program funding participation under this competitive funding program. The projects are: 1. Katella Avenue from Glassell Street to Tustin Street as priority No. 1; and 2. Tustin Street from Meats Avenue to Heim Avenue Although the APM Funding Program is structured to be competitive with all of the agencies in the County of Orange, OCTA has allocated 30 points for each agency's top priority project giving the City a very high competitive edge in getting the top priority project to be funded. It is not known at this time if the lower priority project the City is submitting will be approved. 8. ATTACHMENTS • Resolution 10819 • Project submittal map JD:mfly N:\Public WorksWDMIN\LYoung \Council Items \COUNCIL \Oct 2014 \10- 14 -14\ APM Reso approval & project submittal.doc ITEM 2 10/14/14 O .s Printed on Recycled Paper RESOLUTION NO. 10819 A RESOLUTION OF THE CITY COUNCIL OF THE CITY ORANGE AUTHORIZING APPLICATION FOR FUNDS FOR THE ARTERIAL PAVEMENT MANAGEMENT PROGRAM FUNDED WITH REGIONAL SURFACE TRANSPORTATION PROGRAM FUNDING UNDER THE MOVING AHEAD FOR PROGRESS IN THE 21ST CENTURY FEDERAL TRANSPORTATION ACT FOR KATELLA AVENUE AND TUSTIN STREET REHABILITATION PROJECTS. WHEREAS, the United State Congress enacted the Moving Ahead for Progress in the 21st Century (MAP -21) Federal Transportation Act on July 6, 2012, which makes Regional Surface Transportation Program funds available to the Orange County Transportation Authority (OCTA); and WHEREAS, OCTA has established the procedures and criteria for reviewing proposals; and WHEREAS, City of Orange possesses authority to nominate projects funded using Regional Surface Transportation Program funding, provide sufficient local match, and to finance, acquire, and construct the proposed project; and WHEREAS, by formal action the City Council authorizes the nomination of Katella Avenue and Tustin Street Rehabilitation, including all understanding and assurances contained therein, and authorizes the person identified as the official representative of the City of Orange to act in connection with the nomination and to provide such additional information as may be required; and WHEREAS, the City of Orange will maintain and operate the property acquired, developed, rehabilitated, or restored for the life of the resultant facility(ies) or activity; and WHEREAS, with the approval of the California Department of Transportation (Caltrans) and /or OCTA, the City of Orange or its successors in interest in the property may transfer the responsibility to maintain and operate the property; and WHEREAS, the City of Orange will give Caltrans and/or OCTA's representatives access to and the right to examine all records, books, papers or documents related to the arterial pavement management project; and WHEREAS, the City of Orange will cause project work to commence within six months following notification from the State or OCTA that funds have been authorized to proceed by the Federal Highway Administration and that the project will be carried to completion with reasonable diligence; and
