Bid No. 145 -10; Award of FY 2013 -14 Community Development Block Grant (CDBG) Street
Improvement Projects: Palm Avenue, James Street, Victoria Drive, Shirley Drive, Malena Drive,
Bennett Avenue, and Sherman Avenue Improvements (SP- 3876).
2. SUMMARY
The bids for the CDBG FY 2013 -14 Street Improvement Projects were received and opened on
September 11, 2014. Five (5) bidders responded to the Notice Inviting Bids. The apparent low
bidder is RJ Noble Company, of Orange, CA for $761,656.21. The Engineer's original estimate
was $750,000.00 including contingencies and staff cost. The revised estimated total project cost
is $838,000.00 including 10% contingencies and staff cost. Staff is proposing to transfer funds
from the CDBG Contingency account to cover the shortfall.
3. RECOMMENDED ACTION
1. Award the contract in the amount of $761,656.21 to RJ Noble Company, and authorize the
Mayor and City Clerk to execute the necessary documents on behalf of the City.

4. FISCAL IMPACT
CDBG funds of $768,445 are currently appropriated for this project. Sufficient funds will be
available for the project through the transfer of CDBG contingency funds
(310.9645.57130.11070) to the first five projects listed below. The Bennett Avenue and Sherman
Avenue projects will not require additional funds, because the revised cost estimate is lower than
the budgeted amount.

enhance public safety and improve circulation.
Policy 3.1: Continue to maintain and repair sidewalks and pavement surfaces on public rights -
of -way.
7. DISCUSSION and BACKGROUND
The Federal CDBG Program provides grant funds to enable eligible localities to upgrade Low
and Moderate Income Areas within their jurisdictions. Based on 2000 Census data, designated
areas within the City of Orange qualify for CDBG funds. Eligible activities include
infrastructure upgrades such as street improvements.
These streets were rated in the Citywide Pavement Management Program with a Pavement
Condition Index (PCI) ranging from 24 -42 (out of a maximum score of 100) indicating the need
for street rehabilitation or reconstruction. The scope of rehabilitation in general consists of, but
is not limited to, ADA compliant access ramps, localized removal and replacement of the
existing pavement, asphalt concrete overlay, removal and replacement of failed sections of curb
and gutter, driveways, sidewalks, cross gutters, spandrels, and adjustment of manholes and water
valve covers to grade. The scope of reconstruction is similar to rehabilitation except that all
existing asphalt concrete will be removed and replaced.

The City Council previously approved advertisement for bids on August 12, 2014. The bid
solicitation was advertised on August 20, 2014 for a period of three weeks, and bids were opened
on September 11, 2014. The five received bids are as follows:

The seven streets were bid together for economies of scale and ease of construction coordination.
The revised estimated total project cost is $838,000.00, which includes the apparent low bid of
$761,656.21, and approximately 10% contingencies and staff cost.
Bids for the streets are higher than the construction funds budgeted. To cover the shortfall, staff
is recommending transferring CDBG contingency funds.
The proposed project is categorically exempt from the provisions of the California
Environmental Quality Act (CEQA) under CEQA guidelines Section 15301 "Existing Facilities"
Class 1 (c). The CEQA Notice of Exemption has been filed with the County Recorder's Office.
The proposed project is also categorically excluded from the provisions of the National
Environmental Policy Act (NEPA) under 24 CFR Section 58.35. Documentation of this
determination is on file.
Construction is scheduled to begin in November 2014 and is expected to be completed within
forty -five calendar days.
