SUBJECT Time extension for the Santa Ines Senior Affordable Housing Project Conditional Use Permit 2790 -10, Major Site Plan 0630 -10, Design Review Committee 4483 -10 and Two Concessions in association with a Density Bonus Housing Agreement located at 184 North Prospect Avenue. 2. SUMMARY The applicant proposes to extend the entitlements in order to demolish two buildings previously used as a preschool in order to construct 42 apartments, where 41 of the units would be rented to seniors (62 and older) with extremely low, very low, or low - incomes, and may be mentally disabled. The 42" unit would be a manager's unit. 3. RECOMMENDED ACTION Approve a one -year time extension for Conditional Use Permit 2790 -10, Major Site Plan 0630- 10, Design Review Committee 4483 -10 and Two Concessions in association with a Density Bonus Housing Agreement 4. GENERAL PLAN IMPLEMENTATION Of note is consistency with Housing Element Goal 2.0; Assist in the development of adequate housing to meet the needs of Low -and Moderate Income Housing. The proposed project is consistent with numerous goals and policies of the General Plan. 7. DISCUSSION and BACKGROUND On July 12, 2011, the City Council approved the project as described below: • The demolition of two existing one -story buildings, which were used as a preschool. • Construction of forty -two (42) senior rental apartments. • Forty one (41) of the apartments for rental to low- income seniors. • The 42 unit would be a manager's unit. • A two -story rectangular shaped building, wrapped around an open courtyard. • Approximately 12,248 square feet of usable common open space. • One patio, deck or balcony per unit. • A 1,895 SF indoor community room. • A 1,632 SF open roof top deck on top of the community room, which includes an outdoor fireplace, patio cover, and seating. • An open courtyard with planters, benches, and patio furniture. • Trash enclosures and laundry facilities. • A 54 -space semi subterranean gated parking structure. • 42 personal storage closets that are 250 cubic feet (5'W x 5'D x 10'H). • Vehicular access from Prospect Avenue. • Site and building perimeter landscaping. • Removal of all but two existing on -site trees and replacement with 64 trees. • Perimeter walls and fencing. • A monument sign. • Units for rental to seniors with very low and low incomes. • Units ranging in size from 620SF to 683SF for a one bedroom apartment and 810SF for a two bedroom apartment. ITEM 2 06/10/2014 The application was originally approved on July 12, 2011 with an original expiration date of July 12, 2013. On May 28, 2013, the City Council approved a one -year entitlement extension because the applicant was not been able to construct the project due to the elimination of the Orange Redevelopment Agency (ORA). They were relying on ORA funds to construct the project and did not secure the funds prior to the agency being dissolved. The City Council then extended the entitlement to July 12, 2014, and no further extensions could be sought. However, on May 13, 2014, the City Council introduced and passed for first reading a municipal code amendment relating to extensions of land use entitlement expiration dates. The amendment provides for a three -year extension of entitlements. The new ordinance will be effective July 10, 2014, therefore, the applicant would like to take advantage of the new entitlement extension timeframe with a start date of July 12, 2014. The applicant states in their request letter they are applying for tax credits on July 1, 2014, and the extension would allow the project to be competitive throughout the process. 8.
