BACKGROUND and DISCUSSION Section 1806 of the California Streets and Highways Code provides that, except upon the annexation of territory to the City, no public or private street or road shall become a City street or road until the City Council, by resolution, has caused the street or road to be accepted into the City street system. This particular parcel (APN 390 - 491 -27) was acquired in its entirety for the Chapman Avenue / Tustin Street Intersection Improvement Project in 2011. As part of that project, the northerly 20 feet and the westerly 21 feet of the parcel became part of the street right -of -way. The remainder of the parcel is currently a vacant lot. Without City Council action incorporating the portion that is now street right -of -way, the Assessor will not change their map to reflect the current street configuration. This resolution will incorporate that street right -of -way into the City street system, thus allowing the Assessor to correct the configuration on their maps. Although this parcel is now owned by the City, it is not considered a public street until the City adopts a resolution to expressly accept the parcel into the City street system, and only then it will be shown as a public street by the Orange County Assessor in the Assessor's map book. If you look at the exhibit attached to Resolution No. 10770, you will see that the parcel is described by the County Assessor as a numbered parcel and not a public street. Upon the adoption of Resolution No. 10770 and recordation of a certified copy thereof in the Official Records of the County of Orange, the Assessor's map book will be revised by the County Assessor to show the parcel as part of the City street system. 8.
