SUBJECT Resolution No. 10769 — A Resolution of the City Council of the City of Orange accepting certain roads and streets into the City Street System. 2. SUMMARY Adoption of Resolution No. 10769 will operate to cause certain real property previously acquired by the City for street purposes to be accepted into the City street system. 3. RECOMMENDED ACTION Adopt Resolution No. 10769. 4. FISCAL IMPACT No fiscal impact. 5. STRATEGIC PLAN GOAL(S) 1 d. Provide for a safe community — Assure the development of the City occurs in a fashion that maximizes public safety. 6. GENERAL PLAN IMPLEMENTATION Infrastructure Element Goal 3.0 Ensure adequate maintenance of public rights -of -way to enhance public safety and improve circulation. BACKGROUND and DISCUSSION Section 1806 of the California Streets and Highways Code provides that, except upon the annexation of territory to the City, no public or private street or road shall become a City street or road until the City Council, by resolution, has caused the street or road to be accepted into the City street system. This particular parcel (APN 390 - 483 -35) is currently a portion of Chapman Avenue and is located in the front of the Baskin - Robbins / Togo store at 1610 E. Chapman Avenue. This parcel was acquired by the Orange Redevelopment Agency years ago when the Baskin Robins / Togo building was constructed. The parcel was subsequently conveyed to the City by the Successor Agency to the Orange Redevelopment Agency on January 16, 2014. Now being a City owned parcel, the City may now officially accept the parcel into the City street system. Although this parcel is now owned by the City, it is not considered a public street until the City adopts a resolution to expressly accept the parcel into the City street system, and only then it will be shown as a public street by the Orange County Assessor in the Assessor's map book. If you look at the exhibit attached to Resolution No. 10769, you will see that the parcel is described by the County Assessor as a numbered parcel and not a public street. Upon the adoption of Resolution No. 10769 and recordation of a certified copy thereof in the Official Records of the County of Orange, the Assessor's map book will be revised by the County Assessor to show the parcel as part of the City street system. 8. WHEREAS, Section 1806 of the California Streets and Highways Code provides that, except upon the annexation of territory to the City, no public or private street or road shall become a City street or road until the City Council, by resolution, has caused the street or road to be accepted into the City street system; and WHEREAS, pursuant to Section 1806 of the California Streets and Highways Code, the City Council desires to accept the real property and /or parcel described as Assessor's Parcel No. 390 - 483 -35, which is depicted on the map attached to this Resolution as Exhibit A , into the City street system. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Orange as follows: Section 1. Effective upon the date that a certified copy of this Resolution is recorded in the Official Records of the County of Orange, the real property and /or parcels described as Assessor's Parcel No. 390 - 483 -35, which is depicted on the map attached to this Resolution as Exhibits A , into the City street system. Section 2. The City Clerk is hereby authorized and directed to cause a certified copy of this Resolution, attested by the City Clerk under seal, to be recorded without acknowledgement, certificate of acknowledgement, or further proof in the Official Records of the County of Orange. Section 3. All actions heretofore taken by the officers, employees and agents of the City with respect to the acceptance of conveyance and the recordation of any instrument relating to any and all of the real property and /or parcels described in Section 1 of this Resolution are hereby approved, confirmed and ratified, and the officers and employees of the City are hereby authorized and directed, jointly and severally, to do any and all things and to execute and deliver any and all certificates and documents which they may deem necessary or advisable in order to consummate the acceptance of said streets or roads into the City street system and otherwise to effectuate the purposes of this Resolution.
