HomeMy WebLinkAboutORD 11-26 AMENDING CHAPTER 10.40 OF THE OMC PERTAINING TO PARKING METER ZONESORDINANCE NO. 11-26 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING CHAPTER 10.40 OF THE ORANGE MUNICIPAL CODE PERTAINING TO PARKING METER ZONES WHEREAS, Chapter 10.40 of the Orange Municipal code defines and establishes on and off-street paid parking zones, establishes on and off-street parking meter fees, and establishes mechanics of the paid parking program; and WHEREAS, the purpose of the City's paid parking program is to promote parking availability and turnover within commercial and mixed-use areas while supporting access to businesses, services, and public facilities; and WHEREAS, providing administrative authority to adjust parking time limits within established parameters will allow the City to respond more efficiently to changing parking demands and operational needs while maintaining the objectives of the paid parking program; and WHEREAS, the City desires to authorize the Public Works Director to establish and adjust within parking meter zones,not exceeding four(4)hours. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES HEREBY ORDAIN AS FOLLOWS: SECTION I: That the recitals and findings contained herein are true and correct, incorporated herein, and with the public record, form the basis for this Ordinance. SECTION II: Section 10.40.120 of the Orange Municipal Code, "Vehicles and Traffic- Parking Meters Time of Parking in Parking Meter Zones,"is hereby amended to read as follows: 10.40.120 Time of Parking in Parking Meter Zones. A. The Public Works Director is authorized to establish and adjust the maximum legal parking time for parking spaces within parking meter zones,provided that the maximum legal parking time shall not exceed four (4) hours. The maximum legal parking time shall be indicated by signs adjacent to the parking meter or parking meter stand. Appropriate signage shall be installed or updated to reflect any change in maximum legal parking time prior to enforcement of such change. B. The maximum legal parking time shall not be in excess of any maximum legal parking time which may be prescribed and determined and posted as provided elsewhere in this title. C. Nothing contained herein shall be deemed or construed to permit parking during times or hours prohibited elsewhere in this title. SECTION III: If any section, subdivision, paragraph, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance, and each section, subdivision, paragraph, sentence, clause and phrase thereof, irrespective of the fact that any one (or more) section, subdivision,paragraph, sentence, clause or phrase had been declared invalid or unconstitutional. SECTION IV: The City Clerk is hereby directed to certify the adoption of this Ordinance and cause the same to be published as required by law. This Ordinance shall take effect thirty (30) days from and after the date of its final passage. ADOPTED this 14th day of July 2026. D' ®el R.
