PLANNING COMMISSION RECOMMENDATION TO THE CITY
COUNCIL REGARDING AN ORDINANCE AMENDING TITLE 17 OF
THE ORANGE MUNICIPAL CODE RELATED TO THE ON-SITE SALE
AND SERVICE OF ALCOHOLIC BEVERAGES IN CONJUCTION
WITH A BONA FIDE RESTAURANT

REQUEST:
Public Hearing for Planning Commission recommendation to the City
Council regarding an amendment to Title 17 of the Orange Municipal
Code (Zoning Ordinance) to allow the sale and service of alcoholic
beverages in conjunction with the operation of a bona fide restaurant as
a permitted use in certain zoning districts and establishing standardized
performance standards for restaurants serving alcohol as a secondary
and incidental use to food service.
ENVIRONMENTAL
INFORMATION:
The proposed project is not subject to the provisions of the California
Environmental Quality Act (CEQA) pursuant to (1) Section 15061(b)(3)
of the state CEQA Guidelines (Common Sense Exemption) because it
can be seen with certainty that there is no possibility that it would have a
significant effect on the environment; and (2) Section 15378 because it
will not have a direct or reasonably foreseeable indirect physical change
on the environment and is not a "project." For this reason, no further
CEQA documentation is required.
