ADMINISTRATIVE REPORTS (Continued) 7.2 Report from City Attorney - Continued viability of the Resource Center and secondary impacts of day laborer solicitation. (U1100.0) TAPE 1000 City Attorney David DeBerry stated the proposed ordinances are tailored to address issues caused by a disregard for the rights of private property owners not to have solicitors on their property and solicitation on public sidewalks; while providing reasonable alternatives for day laborers to obtain work. He reviewed the main points of each proposed ordinance.The proposed Ordinance No. 19-07 will regulate the activities of pedestrians and motorists utilizing public rights-of-way and commercial parking lots to solicit for employment services,goods and contributions. Proposed Ordinance No. 23-07, being recommended for review by the Planning Commission, will establish regulations for those businesses that desire to establish private property job centers where day laborers and employers can congregate and enter into employment relationships without resulting in negative secondary effects, such as traffic, safety and use of public rights-of-way.Mr. DeBerry referenced recent statistics on the Resource Center activities which show that since Council mandated the requirement for two forms of identification, the number of users has decreased. He summarized that in its 17 years of existence (with the exception of the first year) it has not had a significant impact on addressing the day laborer problems being experienced on private property and public sidewalks in the City. He noted an article submitted to the Council just prior to the meeting written about the City of Costa Mesa's problems; and information obtained from Orange Police indicating that more businesses in Orange are posting signs prohibiting solicitation.Mayor pro tern Dumitru, noting the numerous attempts which have been made over the years to address this issue, stated that it was his recollection that Council had previously requested establishment of a permitting program which he suggested could serve to help identify the legal status of workers and assist the Police Department with enforcement. In addition, he expressed concern for protecting legal immigrant workers, suggesting the permitting program might achieve this.Mr. DeBerry indicated that the permitting program is an option to be explored, adding that the courts often like to see cities trying less restrictive measures first, and if those fail then more restrictive measures may be acceptable. He also stated that initiating a permitting program would require a great deal of staff time. He stated that the ordinances address the problems and impacts on businesses, but do not speak to the legal status of the day laborer. He added that if the proposed measures do not work, the permit program could be the next step.Mr. DeBerry, responding to Mayor Cavecche's question regarding the difference between obtaining a permit to stand in designated locations for work versus obtaining services at the Resource Center, stated that day laborers usually stand at a street corner, or where construction materials and equipment are sold, to give them more visibility and a better chance CITY COUNCIL MINUTES November 27,2007 7. ADMINISTRATIVE REPORTS (Continued) Mayor Cavecche clarified with staff that the proposed regulations would not affect the sign twirlers who usually stand on corners and that to enforce the new regulations a written notice on file from the property owner would be needed to support a violation of the private property prohibition. Mr. DeBerry stated that with the notices on file the City would be alerted to the problem areas and added that a posted sign would satisfy the requirement as well. He reported that law enforcement has been more visible in the problem areas resulting in the number of individuals congregating dropping. However, this has not solved the problem, as day laborers often scatter when a marked police vehicle shows up and that there is some evidence that lookouts may be warning day laborers of when a police vehicle is approaching. Mayor pro tern Dumitru noted that currently day laborers can be seen standing underneath the posted signs which prohibit their solicitation, and expressed frustration that business owners feel they are not getting the City's support in controlling the problem. Speakers -Bob Holtzclaw Matt Norwalk Robert Lauten Cherie Wood Dee Barrow Susan Currie Debra Bedoy Raymond Herrera Vaughn Becht Robin Vidston Lupe Moreno Marissa Nuncio, National Day Laborer Organizing Network Angelina Ibbotson Jim Gilchrist City Attorney, David DeBerry addressed comments made by the speakers, reporting that a citywide prohibition of day laborer solicitation on public streets and sidewalks would likely not pass a constitutional test. He explained that cities have tried that approach and the courts have found the ordinances unconstitutional, in part because the cities did not have a job center within their jurisdictions, which Orange does. In response to one speaker's comment that an enforcement only policy won't work, he noted the City's 20-year history of attempts to address this through extensive dialogue with both day laborers and community groups, as well as community education. Mr. DeBerry responded to Mayor Cavecche's question as to what can be done to enforce local employers illegally soliciting workers, indicating that the ordinance does apply to employers and significantly raises the amount of the fines. ADMINISTRATIVE REPORTS (Continued) Police Chief, Robert Gustafson reported on the efforts of the Police Department to address the problems through communication with the day laborer community about the existence of the Resource Center. He noted that outreach has occurred with local organization, both in English and Spanish. Chief Gustafson stated that the Police Department has attempted to enforce the Vehicle Code, Penal Code, and the Business and Professions Code, as well as contacting Federal Offices for additional training. He added that 840 police officer hours have been expended over the past months just on the day laborer issue and that this is all one officer does during his entire shift. Mayor pro tern Dumitru stated that the day laborer problem has always been one of the major complaints he has heard since before being on the Council. He cited problems such as depressed wages for legitimate workers; no benefits; cheap labor amounting to slavery; increase of crime; shoplifting at solicitation sites; and noted the Police Department's need for more enforcement tools. He added that the Council action needs to convey a tougher, clearer approach to the problem, adding that the protection of citizens and legal residents is his prImary concern. Councilmember Bilodeau indicated he had opposed the Resource Center originally because it was advertising day care providers - a practice that has been stopped; and because the requirement for identification was dropped. He added that the disrespect for property owner's rights is unacceptable. He stated his support for the measured steps approach to defend property rights and to regain a sense of community.Mayor Cavecche stated that this is a public safety and property rights problem. She added that many cities have struggled to address the problems just to be struck down in the courts and that she is not willing to back down on the issue. She stated her support for a careful strategy being laid out to protect the rights of the people here legally to be able to work. She noted that the City has one full-time officer assigned only to this problem, and that this officer would be better utilized out on the streets patrolling on other matters. She stated her concern with the proposed permitting process, noting that she suspects it may draw in people from other cities. Councilmember Smith stated she also sees problems with the permitting process; reiterating her support for checking identification over issuing permits. She stated that if employers were not hiring, there would not be the incentive for day laborers to gather. She also stated her support for the increase in fines for potential employers. Lastly, she noted that if solicitation is to occur only at a Resource Center, the City may have to establish more centers in other areas of the City. Mayor pro tern Dumitru stated his support for the permit process to identify those who do not use the Resource Center, but would rather stand in front of home center stores; and for those who are legally here and legally qualified to work. MOTION - Smith SECOND - Cavecche AYES - Smith, Cavecche, Dumitru, Bilodeau ABSENT - Murphy Moved to adopt Resolution No. 10241.9.2 ORDINANCE NO. 9-07 (FIRST READING) (A2500.0 Ord-09-07 Plaza Banners)An Ordinance of the City Council of the City of Orange amending Chapters 5.63.020 and 5.63.060 of the Orange Municipal Code relating to changes in procedures for the displayof Plaza banners.Discussion - Mayor Cavecche stated the increase in the number of banners being allowed was excessive for the Historic District and asked for clarification.Councilmember Smith asked whether a fee was charged by the City for hanging the banners.Public Works Assistant Director, Roger Hohnbaum responded that the proposal is to hang banners on each set of street lights for two blocks in each direction on Chapman A venue and one block in each direction on Glassell Street. He stated that the City recoups the cost of hanging the banners from the organization. He further added that the ordinance requires the banners to be brought in two weeks early for inspection and compliance with standards for placement in the Plaza.In response to questions from Council, Mr. Hohnbaum reported that the banners have to be publicizing events occurring in Orange, or on behalf of non-profit organizations based in Orange. He also stated that the banners hung for the International Street Fair event are considered decorations which are not covered in the ordinance. LEGAL AFFAIRS (Continued) Councilmember Smith suggested a policy that organizations in Orange take precedence over others; and that the number of banners allowed be limited to six on Chapman and eight on Glassell. LEGAL AFFAIRS (Continued) 9.5 ORDINANCE NO. 25-07 (FIRST READING) (A2500.0 Fire Code Language)An Ordinance of the City Council of the City of Orange Amending Title 8 of the Orange Municipal Code.MOTION - Bilodeau SECOND - Smith AYES - Smith, Cavecche, Dumitru, Bilodeau ABSENT - Murphy Moved that Ordinance No. 25-07 be read by title only and same was set for second reading by the preceding vote.10. PUBLIC HEARINGS 10.1 SOLID WASTE RATE ADJUSTMENTS (C2500.M.1)Time set for public hearing to consider revised rates for solid waste collection and disposal servIces.The City entered into an agreement with Waste Management of Orange County effective June 1,1999, for the provision of solid waste collection and disposal services. The agreement provides that Waste Management may request a rate adjustment each year based on specific economic factors including changes in the producer price index and County of Orange landfill disposal fees. The agreement also requires that specified residential and commercial rates be within the lowest one- third of all cities in Orange County providing similar solid waste services. Staff has reviewed and validated Waste Management's rate adjustment request. If approved, the rates will become effective January 1, 2008.Discussion - Public Works Assistant Director, Roger Hohnbaum gave the staff report.City Attorney, David DeBerry responding to a question from Mayor Cavecche explained that the adjustment of rates, set forth in the contract as recommended by a consultant hired in 1997,is based on the Producer Price Index (PPI) rather than actual costs based. He indicated that if the rate increases were based on actual costs, an outside auditor would have to be hired each year to analyze the data. He also noted that the contract will be up for renewal in 2009.Mayor pro tern Dumitru asked for a status on a request made by himself and former Councilmember Steve Ambriz that Waste Management post Safe Surrender placards on dumpsters; as the placards have been successful at hospitals and fire stations.Mr. Ross, Waste Management's representative, replied that it was the opinion of Waste Management that there are better ways to educate the public on this social issue; that the notices were ineffective. He cited legislation, and relying on non-profit groups to educate as two ways to accomplish this. He stated that the company felt the notices on the dumpsters were ineffective.Pal! e 13 CITY COUNCIL MINUTES November 27,2007 10. PUBLIC HEARINGS (Continued) Councilmember Smith stated the placards might plant the wrong idea and may not be an appropriate place for Safe Surrender placards. She supported the po stings at hospitals and fire stations; and encouraged the idea of education and posting signs in school restrooms. She suggested that Waste Management could make a contribution toward this education. Public Works Department Senior Administrative Analyst, Jamie Herbon responded to questions from Council, stating that most cities have similar franchise agreements with their waste contractor that base rate increases on the PPI. The Council concluded that Waste Management is requesting the rate increase according to provisions in the agreement and after careful consideration, the City is obligated to approve the rate increase since Waste Management has met all requirements. It was also determined that discussions will take place to pursue a program to educate the public on the Safe Surrender program. RESOLUTION NO. 10236 A Resolution of the City Council of the City of Orange approving revised rates for Solid Waste Collection and Disposal Services. MOTION - Cavecche SECOND - Smith AYES - Smith, Cavecche, Dumitru, Bilodeau ABSENT - Murphy Moved to Adopt Resolution No. 10236 and approve recommended reductions to certain subsidy amounts.Councilmembers Smith and Dumitru to work with Waste Management on a program to educate the public about the Safe Surrender Program.11. ADJOURNMENT There was no 7:00 p.m. Session scheduled for November 27, 2007. The City Council adjourned to an Adjourned Regular Meeting, Study Session, at 8:10 p.m. in the Weimer Room at City Hall, to review the proposed City Strategic Plan. The next regular City Council meeting is scheduled for December 11,2007. Declaration of City Clerk, Mary E.
