Chapman Avenue, Orange California. 4:30 P.M. SESSION 1. ROLL CALL PRESENT - Whitaker, Smith, Cavecche, Dumitru, Bilodeau ABSENT - None 2. PUBLIC COMMENTS - None 3. CONSENT CALENDAR 3.1 Confirmation of warrant registers dated March 3, and March 10, 2011. ACTION: Approved. 3.2 Redevelopment Agency Minutes, Regular Meeting of March 8, 2011and Study Session of February 22, 2011 (Continued from March 8, 2011). (RC2500.D.4) ACTION: Approved. 3.3 First Amendment to Consultant Services Agreement between the Agency and Tierra West Advisors to provide economic consulting services with regard to various economic development, redevelopment and affordable housing projects in the Orange Merged and Amended Redevelopment Project Area. (RA2100.0 Agr- 5454.A.1) ACTION: Approve First Amendment to Consultant Services Agreement; and authorize the Chairman and Agency Clerk to execute on behalf of the Agency. MOTION - Whitaker SECOND - Smith AYES - Whitaker, Smith, Cavecche, Dumitru, Bilodeau All items on the Consent Calendar were approved as recommended. END OF CONSENT CALENDAR PAGE ORANGE REDEVELOPMENT AGENCY MINUTES March 22, 2011 4. REPORTS FROM DIRECTORS — Director Bilodeau reported on the status of SB77 with regard to Redevelopment Agencies; and suggested staff read the City of Fullerton's staff report on this issue. The Board agreed to agendize a discussion on SB 77 for the April 12 meeting. 5. REPORTS FROM BOARDS, COMMITTEES, AND COMMISSIONS - None 6. REPORTS FROM EXECUTIVE DIRECTOR - None 7. ADMINISTRATIVE REPORTS 7.1 Commitment of Housing Set -Aside funds for the proposed Santa Ines Senior Villas to be located at 184 North Prospect Street. (Continued from March 8, 2011.) RC2500.G.1.9) Housing Manager Mary Ellen Laster stated that since the developer did not receive approval on this project, the funds could not be committed. RECOMMENDED ACTION: 1) Authorize the Executive Director to execute the letter regarding the Loan Commitment of Housing Set -Aside funds in the amount of $5,516,000 for the proposed Santa Ines Senior Villas; and 2) Authorize the transfer of $5,516,000 from unreserved fund balance in the Orange Merged Housing Fund (Fund 941) to Housing Loan Programs (Fund 913) and appropriate funds in the amount of $5,516,000 to Account 913.9810.56571.20091 Housing Loan — Santa Ines Project). MOTION - Cavecche SECOND - Whitaker AYES - Whitaker, Smith, Cavecche, Dumitru, Bilodeau Moved to deny recommended actions. 8. LEGAL AFFAIRS — None. PAGE ORANGE REDEVELOPMENT AGENCY MINUTES March 22, 2011 9. RECESS TO CLOSED SESSION The Redevelopment Agency recessed at 8:30 p.m. to a Closed Session for the following purposes: a. Conference With Legal Counsel— Initiation of Litigation Initiation of litigation pursuant to subdivision (c) of California Government Code Section 54956.9: One potential case. b. To consider and take possible action upon such other matters as are orally announced by the General Counsel, the Executive Director or the Board of Directors prior to such recess unless the motion to recess indicates any of the matters will not be considered in Closed Session. 10. ADJOURNMENT — The Redevelopment Agency adjourned at 10:45 p.m. Declaration of the Clerk of the Orange Redevelopment Agency, Mary E. Murphy, declaring posting of Orange Redevelopment Agency Agenda of a regular meeting of March 22, 2011 at Orange Civic Center kiosk, Police facility at 1107 North Batavia, and the Main Public Library at 407 E. Chapman; all of said locations being in the City of Orange and freely accessible to members of the public at least 72 hours before commencement of said regular meeting. M URPH GENCY CLERK PAGE 3
