A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE ACCEPTING A DEDICATION
FROM MILAN REI X, LLC OF A 30.75 ACRES
PARCEL (PARCEL MAP NO. 2021-187 PARCEL
NO.2) (APNS 370-141-19,370-041-12,370-011-08,370-
011-18, 093-280-30, 370-213-01, AND 370-011-21) FOR
INCLUSION IN THE CITY'S OPEN SPACE
RESERVE
WHEREAS, Milan Rei X, LLC ("Grantor") is the owner of the property described
herein and has offered to dedicate Parcel 2 to the City of Orange for the public benefit and for
inclusion in the City's Open Space Reserve; and
WHEREAS, Parcel Map No. 2021-187 was recorded in Book 415, Pages 38-47 of
Parcel Maps, in the Office of the County Recorder of Orange County, creating Parcel 2
consisting of approximately 30.75 acres; and
WHEREAS, Parcel 2 consists of the following Assessor's Parcel Numbers, in whole
or in part: 370-141-19, 370-041-12, 370-011-08, 370-011-18, 093-280-30, 370-213-01, and
370-011-21; and
WHEREAS, acceptance of Parcel 2 is consistent with the City of Orange General
Plan, including the Open Space and Conservation Elements, and will serve the long-term
public interest by preserving natural open space resources; and
WHEREAS, Government Code section 27281 requires that a city accept interests in
real property through a certificate or resolution of acceptance, and the Orange Municipal Code
authorizes the City Council to accept dedications of land on behalf of the City; and
WHEREAS, the City desires to accept fee title to Parcel 2 free of any reversionary
rights, conditions subsequent, reservations, or rights of re-entry, and solely subject to matters
of record as disclosed in the Preliminary Report issued by Commonwealth Land Title
Company, Order No. 932506344.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Orange as follows:
SECTION I:
The City of Orange hereby accepts the dedication of Parcel 2 of Parcel Map No. 2021-
187, as shown in Parcel Map Book 415, Pages 38-47, in the Office of the Orange County
Recorder, consisting of approximately 30.75 acres and comprising APNs 370-141-19
portion), 370-041-12 (portion), 370-011-08 (portion), 370-011-18 (portion), 093-280-30
portion), 370-213-01 (portion/whole), and 370-011-21 (portion).
SECTION II:
The City accepts Parcel 2 in fee simple absolute, without any reversion, condition
subsequent, limitation, right of re-entry, or reservation of rights in favor of the Grantor.
Grantor retains no access rights, development rights, or reversionary interests of any kind.
SECTION III:
The City accepts Parcel 2 subject only to existing matters of record, including
easements, rights-of-way, and restrictions disclosed in Commonwealth Land Title Company
Preliminary Report No. 932506344, and not subject to any unrecorded encumbrances or
newly imposed conditions.
SECTION IV:
The Mayor is authorized to execute any required Certificate of Acceptance pursuant to
Government Code section 27281, and the City Manager, City Clerk, and City Attorney are
authorized to take all actions necessary to complete the transfer and recordation.
SECTION V:
This acceptance shall be effective upon recordation of a City-executed Certificate of
Acceptance pursuant to Government Code section 27281.
