A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ORANGE AUTHORIZING A
REPRESENTATIVE TO SIGN AND FILE A
FINANCIAL ASSISTANCE APPLICATION FOR
A FINANCING AND GRANT AGREEMENT
WITH THE STATE WATER RESOURCES
CONTROL BOARD FOR CITY OF ORANGE
WELL 29
WHEREAS, the City of Orange (the "City") is a municipal corporation which exercises
governmental functions and powers and is organized and existing under the laws of the State of
California; and
WHEREAS, the Orange County Water District(OCWD), who manages the groundwater
basins of north and central Orange County, conducted a study to address treatment of per- and
polyfluoroalkyl substances (PFAS) as required by the California State Water Resources Control
Board(SWRCB) Division of Drinking Water(DDW); and
WHEREAS, water quality sampling of City wells indicated elevated levels of PFAS
species with concentrations exceeding the DDW's Response Levels for PFAS at seven wells and
exceeding the Federal Maximum Contaminant Level at four wells which require treatment for
PFAS removal. To date, four PFAS treatment systems have been completed, and the wells have
been put back into operation; and
WHEREAS, the design and construction of PFAS treatment system facilities is being
fully funded by the OCWD who is not considered as a qualified applicant for the PFAS grant as
it does not own and operate any PFAS-contaminated wells in its service area. Therefore,
OCWD is requesting assistance from the City to apply for a PFAS grant; and
WHEREAS, adoption of Resolution Number 11643 is necessary to support OCWD's
effort in applying for available grants for the construction of a PFAS treatment plant at City Well
29; and
WHEREAS, the City would be the recipient of any awarded grant funds and act in its
capacity as a pass-through agency between the State Water Resources Control Board and the
Orange County Water District for grant funds awarded to the City to offset costs associated with
the design and construction of the City of Orange Well 29 PFAS Treatment Systems.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Orange
resolves, finds and determines, on the basis of the facts set forth in the agenda report presented to
it, as follows:
1.The Director of Public Works (the "Authorized Representative") or designee, is hereby
authorized and directed to sign and file, for and on behalf of the City, a Financial
Assistance Application for a financing and grant agreement with the State Water
Resources Control Board for the planning, design, and construction of the City of Orange
Well 29 PFAS Treatment Plant.
2.The Authorized Representative, or designee, is designated to provide the assurances,
certifications, and commitments required for the financial assistance application,
including but not limited to executing a financial assistance agreement from the State
Water Resources Control Board and any amendments or changes thereto.
3. The Authorized Representative, or designee, is designated to represent the City in
carrying out the City's responsibilities under the financing agreement, including
certifying disbursement requests on behalf of the City and compliance with applicable
state and federal laws.
