A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ORANGE AUTHORIZING AN
APPLICATION FOR FUNDS FOR THE
ENVIRONMENTAL CLEANUP, TIER 1 GRANT
PROGRAM UNDER ORANGE COUNTY LOCAL
TRANSPORTATION ORDINANCE NO. 3 FOR
THE WHITE OAK RIDGE & PALMYRA
AVENUE WATER QUALITY STORM DRAIN
IMPROVEMENT PROJECT
WHEREAS, the City of Orange ("City") is a municipal corporation which exercises
governmental functions and powers, and is organized and existing under the laws of the State of
California; and
WHEREAS, Orange County Local Transportation Ordinance No. 3, adopted July 24,
2006, and is known and cited as the Renewed Measure M Transportation Ordinance and
Investment Plan, authorizes funding through the Environmental Cleanup Program to help protect
Orange County beaches and waterways from transportation-generated pollution(urban runoff)and
improve overall water quality; and
WHEREAS, the Environmental Cleanup, Tier 1 Grant Program consists of funding
purchases and installation to catch basins with Best Management Practices,such as screens, filters,
inserts, and other"street-scale" low flow diversion projects.; and
WHEREAS, Orange County Transportation Authority (OCTA) has established
procedures and evaluation criteria for eligible projects under this program; and
WHEREAS, the City has the legal authority to nominate water quality improvement
projects that have a transportation pollution nexus and to finance and construct such projects; and
WHEREAS, the City Council authorizes the nomination of the White Oak Ridge &
Palmyra Avenue Water Quality Storm Drain Improvement Project ("Project") for grant funding
under this program; and
WHEREAS, the City will maintain and operate any equipment funded through the grant
and to provide OCTA with access to all records related to the Project; and
WHEREAS,the City will cause work on the Project to be commenced within a reasonable
time after receipt of notification from OCTA and that the Project will be carried to completion
with reasonable diligence; and
WHEREAS, the City will comply where applicable with provisions of the California
Environmental Quality Act("CEQA"),the National Environmental Policy Act,the American with
Disabilities Act, and any other federal, state, and/or local laws,rules and/or regulations; and
WHEREAS,the City has determined that the Project is categorically exempt from CEQA
pursuant to Section 15301 (Class 1 — Existing Facilities) and/or Section 15303 (Class 3- New
Construction or Conversion of Small Structures) as the Project involves minor alterations to
existing public infrastructure and installation of small new equipment; and
WHEREAS,projects funded by Measure M Net Revenues must be included in the City's
seven-year Capital Improvement Program("CIP"); and
WHEREAS, the City will formally amend its CIPS to include the Project upon funding
approval by the OCTA Board of Directors; and
WHEREAS, the City will provide a minimum of 20% in matching funds for the Project
as required by the OCTA Comprehensive Transportation Funding Programs Guidelines.
NOW, THEREFORE,BE IT RESOLVED that the City Council of the City of Orange,
hereby finds that the Project is categorically exempt from CEQA and authorizes the Public Works
Director,or designee,to submit an application for funding under the Environmental Cleanup,Tier
1 Grant Program for the White Oak Ridge & Palmyra Avenue Water Quality Storm Drain
Improvement Project and to act as the City's official representative in all matters pertaining
thereto.
BE IT FURTHER RESOLVED that the City Council of the City of Orange agrees to
provide its required share of the Project and to cover any costs exceeding the funded amount.
