HomeMy WebLinkAboutRES-11609 RENEWING MILITARY EQUIPMENT POLICYRESOLUTION NO. 11609 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE, RENEWING ITS MILITARY EQUIPMENT POLICY WHEREAS, on September 30, 2021, Governor Gavin Newsom signed into law Assembly Bill 481 ("AB 481"), adding Chapter 12.8, "Funding, Acquisition and Use of Military Equipment",to Division 7 of Title 1 of the Government Code(Sections 7070—7075), relating to the use of military equipment by California law enforcement agencies; and WHEREAS,AB 481 seeks to provide transparency, oversight, and an opportunity for meaningful public input on decisions regarding whether and how military equipment is funded, acquired,or used; and WHEREAS, AB 481 requires the Orange Police Department to submit to the City Council an annual military equipment report for each type of military equipment approved by the City Council; and WHEREAS, the City Council shall review its Ordinance approving the funding, acquisition, or use of military equipment at least annually and vote on whether to renew the Ordinance at a regular meeting; and WHEREAS, the City Council shall determine, based on the Annual Military Equipment report submitted, whether each type of military equipment identified in the annual report has complied with the standards for approval set forth in its Ordinance; and WHEREAS, the City Council has reviewed the Annual Military Report submitted by the Orange Police Department and determined the military equipment has complied with the standards for approval set forth in its Ordinance; and WHEREAS, the City Council voted to renew Ordinance No. 03-22 by resolution of the City Council as set forth below. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Orange as follows: SECTION 1. The above recitals are true and correct and are a substantial part of this resolution. SECTION 2. City of Orange Ordinance No. 03-22 is hereby renewed. SECTION 3. The City Council finds that this Resolution is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines,California Code of Regulations,Title 14,Chapter 3,because it has no potential for resulting in physical change to the environment, directly or indirectly. The term "military equipment" is defined in California Government Code section 7070; and WHEREAS, AB 481 allows the governing body of a city to approve the funding, acquisition, or use of military equipment within its jurisdiction only if it makes specified determinations; and WHEREAS,the proposed military equipment use policy is attached hereto as Exhibit A" and incorporated herein by this reference(the"Military Equipment Policy"); and WHEREAS, the Military Equipment Policy was published on the City of Orange Police Department's internet website on April 4, 2022,more than 30 days before the Military Equipment Policy was first considered at a public meeting before the City Council on May 10, 2022; and WHEREAS, the Military Equipment Policy meets the requirements of California Government Code section 7070, subdivision (d). NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES HEREBY ORDAIN AS FOLLOWS: SECTION I The recitals stated above are true and correct, incorporated herein, and form the basis for the adoption of this Ordinance. SECTION II 1) The proposed Ordinance is exempt from the provisions of the California Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15060(c)(2) and 15060(c)(3), because the Ordinance simply provides procedural noticing and posting requirements.The 15378. 2) The proposed Ordinance is exempt from CEQA per CEQA Guideline 15061(b)(3) because it can be seen with certainty, after review and evaluation of the facts regarding the Ordinance and its application, that there is substantial evidence that adoption of the Ordinance would not have a significant effect on the environment and the common sense exemption applies. 3) In the unlikely event adoption of the Ordinance would constitute a project under CEQA, it is categorically exempt from the provisions of CEQA per CEQA Guideline 15321(a) Class 21, Enforcement Actions by Regulatory Agencies) because said adoption is an action taken by the City as a regulatory agency and involves "enforcement of a law, general rule, standard, or objective, administered or adopted by the regulatory agency." SECTION III Based on the above facts, in addition to information provided to the City Council at the public meeting, the City Council approves and adopts the Military Equipment Policy, based on the following findings: 1. The military equipment identified in the Military Equipment Policy is necessary because there are no reasonable alternatives that can achieve the same objectives of officer and civilian safety. 2. The Military Equipment Policy will safeguard the public's welfare, safety, civil rights, and civil liberties. 3. The military equipment identified in the Military Equipment Policy is reasonably cost effective compared to available alternatives that can achieve the same objective of officer and civilian safety. 4. All prior military equipment use complied with the City's policies that were in effect at the time. SECTION IV If any section, subdivision, paragraph, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance, and each section, subdivision, paragraph, sentence, clause and phrase thereof,irrespective of the fact that any one(or more) section, subdivision, paragraph, sentence, clause or phrase had been declared invalid or unconstitutional. 2 SECTION V The City Clerk is hereby directed to certify the adoption of this Ordinance and cause the same to be published as required by law. Military equipment— Includes but is not limited to the following: Unmanned, remotely piloted, powered aerial or ground vehicles. Mine-resistant ambush-protected (MRAP) vehicles or armored personnel carriers. High mobility multipurpose wheeled vehicles (HMMWV), two-and-one-half-ton trucks, five-ton trucks, or wheeled vehicles that have a breaching or entry apparatus attached. Tracked armored vehicles that provide ballistic protection to their occupants. Command and control vehicles that are either built or modified to facilitate the operational control and direction of public safety units. Weaponized aircraft, vessels, or vehicles of any kind. Battering rams, slugs, and breaching apparatuses that are explosive in nature. This does not include a handheld, one-person ram. Firearms and ammunition of .50 caliber or greater,excluding standard-issue shotguns and standard-issue shotgun ammunition. Specialized firearms and ammunition of less than .50 caliber, including firearms and accessories identified as assault weapons in Penal Code § 30510 and Penal Code § 30515, with the exception of standard-issue firearms. Any firearm or firearm accessory that is designed to launch explosive projectiles. Noise-flash diversionary devices and explosive breaching tools. Munitions containing tear gas or OC, excluding standard, service-issued handheld pepper spray. Area denial electroshock devices, microwave weapons, water cannons, long-range acoustic devices (LRADs), acoustic hailing devices, and sound cannons. Kinetic energy weapons and munitions. Military Equipment- 1 Published with permission by Orange Police Department Orange Police Department Orange PD Policy Manual Military Equipment 706.2 POLICY It is the policy of the Orange Police Department that members of this department comply with the provisions of Government Code § 7071 with respect to military equipment. 706.3 MILITARY EQUIPMENT COORDINATOR The Chief of Police should designate an employee of this department to act as the military equipment coordinator. The responsibilities of the military equipment coordinator include but are not limited to: a) Acting as liaison to the governing body for matters related to the requirements of this policy. b) Identifying department equipment that qualifies as military equipment in the current possession of the Department, or the equipment the Department intends to acquire that requires approval by the governing body. c) Conducting an inventory of all military equipment at least annually. d) Collaborating with any allied agency that may use military equipment within the jurisdiction of Orange Police Department (Government Code § 7071). e) Preparing for, scheduling, and coordinating the annual community engagement meeting to include: 1. Publicizing the details of the meeting. 2. Preparing for public questions regarding the department's funding, acquisition, and use of equipment. f) Preparing the annual military equipment report for submission to the Chief of Police and ensuring that the report is made available on the department website(Government Code § 7072). g) Establishing the procedure for a person to register a complaint or concern, or how that person may submit a question about the use of a type of military equipment, and how the Department will respond in a timely manner. 706.4 MILITARY EQUIPMENT INVENTORY The following constitutes a list of qualifying equipment for the Department: See attachment: 2025 Military Equipment Inventory.pdf 706.5 APPROVAL The Chief of Police or the authorized designee shall obtain approval from the governing body by way of an ordinance adopting the military equipment policy. As part of the approval process, the Chief of Police or the authorized designee shall ensure the proposed military equipment policy is submitted to the governing body and is available on the department website at least 30 days prior to any public hearing concerning the military equipment at issue (Government Code § 7071). Military Equipment-2 Published with permission by Orange Police Department Orange Police Department Orange PD Policy Manual Military Equipment a) Requesting military equipment made available pursuant to 10 USC § 2576a. b) Seeking funds for military equipment, including but not limited to applying for a grant, soliciting or accepting private, local, state, or federal funds, in-kind donations, or other donations or transfers. c) Acquiring military equipment either permanently or temporarily, including by borrowing or leasing. d) Collaborating with another law enforcement agency in the deployment or other use of military equipment within the jurisdiction of this department. e) Using any new or existing military equipment for a purpose, in a manner, or by a person not previously approved by the governing body. f) Soliciting or responding to a proposal for, or entering into an agreement with, any other person or entity to seek funds for, apply to receive, acquire, use, or collaborate in the use of military equipment. g) Acquiring military equipment through any means not provided above. 706.6 EXIGENT CIRCUMSTANCES In exigent circumstances and with the approval of the Chief of Police or their designee, the department may acquire, borrow and/or use military equipment that is not included in the Military Equipment Use Policy. If the department acquires, borrows, and/or used military equipment in exigent circumstances, in accordance with this section, it must take all of the following actions: Provide written notice of that acquisition nor use to the City Council within 30 days following the commencement of the exigent circumstances, unless such information is confidential or privileged under local, state or federal law. If it is anticipated that the use will continue beyond the exigent circumstances, the department will submit a proposed amendment to the Military Equipment Use Policy to the City Council within 90 days following the borrowing, acquisition, and/or use, and receive approval, as applicable, from the City Council. Include the military equipment in the department's next annual Military Equipment Report. 706.6.1 COORDINATION WITH OTHER JURISDICTIONS Military equipment used by any employee of this department shall be approved for use and in accordance with this department policy. Military equipment used by other jurisdictions that are providing mutual aid to this department shall comply with their respective military equipment use policies in rendering mutual aid should not be used by any other law enforcement agency or personnel in this jurisdiction unless the military equipment is approved for use in accordance with this policy. 706.7 ANNUAL REPORT Upon approval of a military equipment policy,the Chief of Police or the authorized designee should submit a military equipment report to the governing body for each type of military equipment Copyright Lexipol,LLC 2025/04/09,All Rights Reserved. The Chief of Police or the authorized designee should also make each annual military equipment report publicly available on the department website for as long as the military equipment is available for use. The report shall include all information required by Government Code § 7072 for the preceding calendar year for each type of military equipment in department inventory. 706.8 COMMUNITY ENGAGEMENT Within 30 days of submitting and publicly releasing the annual report, the Department shall hold at least one well-publicized and conveniently located community engagement meeting, at which the Department should discuss the report and respond to public questions regarding the funding, acquisition, or use of military equipment.
