A RESOLUTION OF THE PLANNING COMMISSION
RECOMMENDING THAT THE CITY COUNCIL
APPROVE AN ORDINANCE AMENDING TITLE 17 OF
THE ORANGE MUNICIPAL CODE TO AMEND
PROVISIONS RELATED TO APPLICATION
EXPIRATION, NOTICING REQUIREMENTS AND THE
TIME FOR APPEAL
APPLICANT: CITY OF ORANGE
WHEREAS, staff is continuing its ongoing effort to review the language contained in the
City of Orange's Title l7 ("Zoning Ordinance") with respect to general administrative matters;
and
WHEREAS, the purpose of staff s continuing review is to streamline processes, where
possible, clarify ambiguities and/or address issues that either have not been addressed or are not
clearly and/or fully addressed by the Zoning Ordinance; and
WHEREAS, staff has determined that there is excess and unnecessary verbiage
throughout various sections of the Zoning Ordinance which should be deleted in order to
increase clarity and understanding of OMC requirements for both staff and the public; and
WHEREAS, staff also believes that allowing an application to expire after six months of
inactivity and allowing "reactivation" causes the City and staff to have a backlog of "stale"
applications that needlessly burden staff s workload and assignments and delays processing of
other applications; and
WHEREAS, staff believes that appeals can be processed more efficiently, giving
applicants, appellants, and the public quicker certainty as to whether a project will or will not
proceed, without imposing confusing notice and notification requirements, when Brown Act
noticing is sufficient notice for appellants and the public; and
WHEREAS, staff also believes that the Zoning Ordinance should reflect the City's
current requirements, as contained in the Table within Section 17.08.040, to require noticing for
only certain administrative determinations that do not entail hearings; and
WHEREAS' further, staff believes that a shortened appeal period will also increase
efficiency and certainty in the development process; and
WHEREAS, the Planning Commission, having considered the proposed Ordinance at a
public hearing held on August 19,2024, including review of the staff report and having received
public testimony on the item, has determined the proposed amendment is justified and
recommends approval thereof.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission recommends
the City Council approve the subject Ordinance included as Attachment A to this Resolution,
attached hereto.
