A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE, CALIFORNIA, SUPPORTING
ASSEMBLY BILL 2309
WHEREAS, Assembly Bill 2309 amends California Government Code Section 41803.5
so local legislative bodies may pass an ordinance authorizing state misdemeanor prosecutorial
authority to the City Attorney without prior District Attorney consent; and
WHEREAS, local governments possess a thorough understanding of the public safety
challenges and needs their communities face; and
WHEREAS, state misdemeanors, like any legal violation, impacts communities
suggesting that local agencies should have a voice in how to handle these occurrences; and
WHEREAS, in nearby agencies, state misdemeanors have been dismissed even when the
local City Attorney made attempts to secure permission from the District Attorney to prosecute
the case; and
WHEREAS,Assembly Bill 2309 recognizes the value in extending local control to cities,
empowering them with the tools to secure justice for their communities; and
WHEREAS, this legislation will reinforce accountability in prosecuting state
misdemeanors, promote local control, and help preserve the safety of the Orange community.
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Orange as
follows:
Section 1: The Orange City Council does hereby support Assembly Bill 2309.
Section 2: The Orange City Council authorizes the City Manager to sign letters or utilize
other formal means of communication to support the passage of Assembly Bill 2309.
Section 3: This resolution shall take effect immediately upon its adoption by the City
Council, and the City Clerk shall certify the vote adopting the resolution.
