THIS COVENANT AND AGREEMENT AND DECLARATION OF
RESTRICTIONS is made and entered into this day?I17/2 DATE)by William Selman and
Julie Selman,(the"Owners")as owners of the real property located at 945 N. Shaffer Street,
Orange,California 92867("the Property")and more particularly described as:
See Exhibit A)
RECITALS
WHEREAS, the undersigned desires to construct a one-story, detached habitable
accessory structure with a space not larger than 653-sq.ft.that would have plumbing and cooking
facilities. The plans show a building that has indoor/outdoor entertaining space containing a 653-
sq. ft. open room for cooking facilities with two exterior bathrooms, laundry room and storage
room and an attached covered patio;and
WHEREAS, the undersigned desires to limit the use of the structure to private
indoor/outdoor entertaining recreational purposes only; and
WHEREAS,the detached accessory structure shall serve an ancillary use to the primary
residence,and shall not be used,rented, sold, or leased as a separate dwelling unit. It is agreed
that the Property is limited to single family use. No bedrooms are permitted to be constructed or
installed within the accessory structure.
NOW THEREFORE,for the purpose of complying with the said condition and obtaining
a building permit,the undersigned hereby covenants and agrees.to the following:
1. The foregoing recitals are true and correct and hereby incorporated by reference as the
expressed description and intended use of the Property. Owner shall only improve and use the
Property in the manner described herein. Any use or improvements made other than those stated
herein without prior written approval of the City shall be an express violation of this Covenant and
Agreement and Declaration of Restrictions.
2. The terms and conditions of this Covenant and Agreement and Declaration of Restrictions
may be enforced by the City of Orange. Should the City bring action to enforce any of the terms
herein, the prevailing party shall be entitled to reasonable attorney fees, witness fees, and other
reasonable cost of suit.
3. This Covenant and Agreement and Declaration of Restrictions shall not, in any way,
preclude or limit the ability of the City of Orange to pursue any and all other actions available at
law or equity in relation to this structure.
4. This Covenant and Agreement and Declaration of Restrictions shall run with the land and
all of its terms shall be binding on the undersigned, their heirs, successors and assigns, and shall
continue in effect until released in writing by the City of Orange.
IN WITNESS WHEREOF, the undersigned has caused this Covenant and Agreement
and Declaration of Restrictions to be executed the day and year written above.
