ORD-20-90 AMENDING TITLE 17 TO ALLOW THE UNLIMITED KEEPING OF BIRDS AS PETS IN SINGLE FAMILY AND MULTI-FAMILY DISTRICTSORDINANCE NO. 20- 90 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING TITLE 17 OF THE ORANGE MUNICIPAL CODE TO ALLOW THE UNLIMITED KEEPING OF BIRDS AS PETS IN SINGLE FAMILY AND MULTI- FAMILY DISTRICTS.WHEREAS, after a duly advertised public hearing on March 5,1990, the Planning commission adopted Resolution No. PC-22-90 which recommended to the city Council that the unlimited keeping of birds as pets in the R- 1-6, R-1-7, R-1-8, R- 1-10, R-1-12,R-1-15, R-1-20, R-1-40, R-2, R-3 and R- 4 Districts: and WHEREAS, the City Council held a public hearing on May 15,1990, to consider the recommendation of the Planning commission to allow the unlimited keeping of birds as pets in the single family and mUlti- family districts in the City: and WHEREAS, the City Council upheld the recommendation of the Planning commission and determined that this Ordinance should be adopted.NOW, THEREFORE, the City Council of the city of Orange does hereby ordain as follows:section I:Amend section 17.04. 030 of the Orange Municipal Code entitled "B" words, Terms, and Phrases" to read as follows:17.04.030 "B" Words.Terms. and Phrases.Birds. Birds shall include, but are not limited to,budgies, buntings, canaries, cardinals, cockatiels, cockatoos,conures, doves, finches, lories, lorikeets, lovebirds, macaws,mynahs, parakeets, parrots, pigeons, sparrows, toucans, and weavers. Additional bird species can be considered as pets subject to approval from the Director of Community Development.section II:Amend section 17.04. 170 of the Orange Municipal Code entitled "P" Words, Terms, and Phrases" to read as follows:17.04.170 " P" Words. Terms. and Phrases. section III: Amend section 17.10.030 entitled "Uses Permitted" to read as follows: Delete the word "birds" from subsection 1- 3.section IV:Amend section 17.10.030 by adding subsection 1-4 to read as follows:I.4. The keeping of more than five birds ( not including poultry) as pets or as a hobby subject to the following standards:a. The occasional sale of birds would be permitted if such sale is incidental to the keeping of the bird as a pet or for a hobby.b. All birds permitted under this section shall be confined indoors or in a coop or aviary.c. Coops or aviaries shall at all times be maintained in a clean and sanitary condition and shall at all times be free of offensive odors.d. The city's Code Enforcement Supervisor or designee shall be responsible for determining if the keeping of birds permitted under this section constitutes a nuisance, health or safety hazard, and are in violation of subsections a, b, and c above. section V:A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five days prior to the City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance's passage in the Orange City News, a newspaper of general circulation, published, and circulated in the City of Orange. The city Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted Ordinance along with the names of those city Council members voting for and against the Ordinance in accordance with Government Code section 36933.
