AN
ORDINANCE OF TIlE CITY COUNCIL OF THE CITY OF ORANGE AMENDING
SECTION 9114 OF THE ORANGE MUNICIPAL CODE AMENDING
THE DEFINITION OF A VARIANCE AND ADDING A DEFINITION
OF ADMINISTRATIVE ADJUSTMENT PERMIT.THE
CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLIDWS:gfTION
I:Variance
Defined: A variance is a waiver or modification of some
requirement contained in the Zoning Ordinance which may
be granted only when, because of special circumstances,applicable
to the property, including size, shape, topography,location
or surroundings, the strict application of the Zoning
Ordinance deprives such property of privileges enjoyed by
other property in the vicinity and under identical zoning classification.
Any variance granted shall be subject to such
conditions as will assure that the adjustment thereby authorized
shall not constitute a grant of special privileges inconsistent
with the limitations upon other properties in the
vicinity and zone in which such property is situated.A
variance is granted at the discretion of the Planning Commission
or Zoning Administrator upon verification of findings
as outlined above and is not the automatic right of
any applicant. A variance shall not be granted for a parcel
of property which authorizes a use or activity which is
not otherwise expressly authorized by the zone regulation governing
the parcel of property.Adminis

is a special permit which will allow minor adjustments to
certain requirements set forth in the Zoning Ordinance as more
particularly described in Section 9130.4(c) when it can be
shown that strict compliance would be impractical or undesirable
in meeting the purpose and intent of the ordin-ance
and that the adjustment will not have an adverse effect on
the adjoining properties. An Administrative Adjustment Permit
is granted at the discretion of the Zoning Administra-tor,
subject to limitations set forth in the Zoning Ordinance and
is not the automatic right of any applicant.SECTION
II:This
ordinance shall be published once within fifteen (15)days
after its passage in the Orange City News, a newspaper of general circulation,
published and circulated in the City of Orange, and shall take
effect thirty (30) days from and after the date of its final passage.
