70 AN ORDINANCE OF THE CITY OF ORANGE
ADOPTING AN AMENDMENT TO THE ORANGE MUNICIPAL
CODE REGULATING THE ESTABLISHMENT OF
BUILDINGS CONTAINING LESS THAN 200 SQUARE FEET
OF FLOOR
AREA.THE CITY COUNCIL OF THE CITY OF ORANGE DOES
ORDAIN AS
FOLLOWS:SECTION
I:Section 9108(f) of the Orange Municipal Code
is hereby amended to add Subdivision 4 to read as
follows:Section 9108 (f)
4.Any building, with a gross floor area of less
than two hundred (200) square feet, all of the walls
of which are separated from any larger buildings
devoted to any commercial use, which is used for the
conduct of a principal or primary permitted use and which
is occupied or designed to be occupied by one or
more persons engaged in the retail sale of goods or
ser-vices from said building, and such a building is
not an accessory building within the meaning of this
code,shall require approval of a conditional use
permit.Provided, however, that no conditional use
permit shall be required for any building or
structure containing less than the aforementioned gross
floor area provided such building or structure is
located in a commercial center entirely within
pedestrian mall areas and not accessible to any traffic
other than pedestrian traffic. Provided, further,
that nothing contained herein shall permit the
establish-ment of any such building or structure for
the conduct of a principal or primary permitted use
in any M-l or
M-2
zone."SECTION II:This ordinance shall be pas ted at
three (3) public places within the City of Orange as
designated by ordinance within fifteen (15) days after passage by the
City Council of the City of Orange in accordance with the
requirements of law of the State of California, and shall take
effect thirty (30)days from and after the date of
its final passage.ADOPTED this 30thday
