70 AN URGENCY ORDINANCE OF THE CITY OF
ORANGE ADDING SECTION 3500.2 TO THE ORANGE
MUNICIPAL CODE PROHIBITING THE MANUFACTURE, USE,
SALE OR POSSESSION OF A BLOWGUN HAVING A
BARREL GREATER THAN 18 INCHES IN
LENGTH.WHEREAS, there have appeared persons within
the city limits of the City of Orange possessing and
purporting to sell blowguns having a barrel exceeding eighteen
inches in length,
and WHEREAS, investigation of these devices reveal
that the projectiles can be very dangerous to persons or
property and that for the reasons hereinafter stated, the
prohibition of these devices should be accomplished
immediately.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY
OF ORANGE DOES ORDAIN AS
FOLLOWS:SECTION
I:Section 3500.2 shall be added to the Orange
Municipal Code reading as
follows:Section 3500.
2 Any person who manufactures or causes to
be manufactured, brings into the City of
Orange,keeps for sale, or offers or exposes for
sale,or who gives, lends, or possesses any
instrument or weapon of the kind commonly known as a
blow-gun which has a barrel length greater
than eighteen (18) inches and which is used to
propel any proj ec tile by means of human breath or
compressed air or gas, shall be guilty of a
misdemeanor.The aforementioned and described blowgun
devices are hereby declared nuisances and shall be
sub-ject to confiscation and summary
destruction whenever found within the City of
Orange.
II SECTION
II:The reasons for the urgency of this ordinance
are as
follows:Persons have been observed within the city
limits of the City of Orange in possession of, and attempting to
sell,blowguns used to propel a projectile by means of the
human breath and having a barrel length greater than eighteen
inches,which blowgun has been proven by experimentation to be
very accurate and to be capable of inflicting great injury
to pers ons and damage to
property.
The danger exists that persons will attempt to
manufacture, sell, possess and use such long-barreled
blow-guns within the City with the resultant danger to
persons and property and that persons may attempt to use
these extremely accurate devices as weapons for illegal
purposes unless there is an immediate prohibition on the
manufacture,possession, sale, and use of these
devices.Therefore, pursuant to the procedures of
Section 36934 of the Government Code, the City Council of the
City of Orange hereby enacts this ordinance as an urgency
ordinance in order to protect the public health, safety and
welfare during the period necessary to enact a permanent
ordinance governing the matters contained
herein.ADOPTED this 12th day of May,
