ORD-30-89 ADDS SUBSECTION 5 DECLARING CERTAIN PRIVATE STREET OF 30 FOOT WIDTH 900 FOOT LENGTH AT NORTH BOUND ARIESORDINANCE NO. 30- 89 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING SECTION 10.18.010 OF THE ORANGE MUNICIPAL CODE BY ADDING SUBSECTION 5 THERETO AND DECLARING THAT CERTAIN PRIVATE STREET OF 30 FOOT WIDTH AND APPROXIMATELY 900 FOOT LENGTH LOCATED ALONG THE NORTH BOUND-ARIES OF PARCELS 1 THROUGH 4 OF TENTATIVE PARCEL MAP 89-149 TO BE SUBJECT TO PUBLIC ENFORCEMENT OF NO STOPPING REGULATIONS ON SAID PRIVATE STREET.WHEREAS, as a condition of approval of Parcel Map 89-149 and Conditional Use Permit 1747-89, there is a requirement that the private access street, approximately 30 feet and 927 feet long,shall be posted for "No Parking" and all curbs painted red including off- site to Batavia Street; and WHEREAS, after a dUly- noticed public hearing on October 10,1989, the city Council determined that the aforementioned private access street shall be subject to public enforcement of no'stopping regulations as p+ovided in California Vehicle Code Section 21107.6 to assure that the street shall remain open for emergency vehicles at all times.THE CITY COUNCIL OF THE CITY OF ORANGE DOES HEREBY ORDAIN AS FOLLOWS:Section I:Amend section 10.18.010 of Chapter 10.18 of the Orange Municipal Code to add subsection 5 to read as follows:5. A prohibition of vehicle stopping or parking is established on the private street easement along the northerly boundaries of Lot 4 of that certain Orange County parcel map recorded in the Office of the Orange County Recorder on January 29,1971, in book 34 at page 28 and on lots 1, 6, 7 and 12 of Parcel Map 89-149. The private street easement lies parallel to the Collins Channel of the Orange county Flood Control District. Said easement is 30 feet wide and extends westerly from Batavia Street to the westerly boundary of Lot 12 of Parcel Map 89- 149, a distance of 927 feet.SECTION II:This ordinance shall be published once within fifteen (15)days after its passage general circulation, published and circulated in the city of Orange, and shall take effect thirty (30) days from and after the date of its final passage.
