AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF ORANGE ADOPTED AS AN URGENCY
MEASURE TO AMEND THE BUILDING SECURITY
STANDARDS OF ORANGE MUNICIPAL CODE
SECTION 15.52.090
WHEREAS, the city Council has determined that a threat of
the public welfare and safety exists due to the involvement of
certain new tools which can be employed to illegally enter
buildings and units of buildings having exterior doors utilizing
lever-handled hardware without leaving signs of forced
entry;
and WHEREAS, danger posed by such misuse of available tools
can be mitigated or eliminated by the use of threshold plates
and other mechanisms designed to prevent passage of such a
tool under the door;
and WHEREAS, the anticipated benefits of requl.rl.ng
such additional security measures will far outweigh the
relatively minimal cost of requiring such security
measures.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
ORANGE ORDAINS AS
FOLLOWS:Section
I:section 15.52.090 of the Orange Municipal Code shall
be amended to add a new subsection B.3 to read as
follows:B.3 Every single or double exterior door equipped
with lever-handled locking mechanism hardware shall have
an approved handicapped-accessible threshold complying
with provisions of Title 24 of the Uniform Building Code (as amended
from time to time) beneath the door. The opening between
the threshold and the door shall be secured in a manner approved
by the Crime Prevention Bureau of the Orange Police
Department designed to prevent the passing of rigid materials
or mechanical devices between the door and the threshold for the
purposes of unlocking the door from
the interior
side.Section II:This Ordinance No. 16-89
shall become effective immediately and is adopted as an urgency measure if passed
by not less than four-fifths
vote of
the City Council.Section III:The facts justifying the enactment
of this Ordinance as an
urgency
This Ordinance is for the immediate preservation of the
public peace, and safety in that a new tool designed to be used
by a locksmith with the opening of lever-handled doors from
the inside has recently been made available on the open
market.This tool can be used illegally to obtain entrance into
places of business and residences without leaving any physical
evidence or signs of forced entry that would indicate that an
illegal breaking and entering had taken place. Failure to enact
this Ordinance as an urgency measure would likely result in
increased use of this new tool to commit crimes as its
availability becomes known to persons intending to perpetrate
burglaries,rapes and other crimes involving breaking and
entering.ADOPTED this 25th day of JULY
