ORD-11-89 AMENDING TITLE 17 OF THE OMC TO DELETE R 1 E ONE ACRE ESTATE RESIDENCE DISTRICT CHANGE THE MINIMUM BUILDING SITE AREA IN A SINGLE FAMILY RESIDENCE DISTRICTORDINANCE NO. 11- 89 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING TITLE 17 OF THE ORANGE MUNICIPAL CODE TO DELETE CHAPTER 17.25 ENTITLED "R-l- E ONE-ACRE ESTATE RESIDENCE DISTRICT" IN ITS ENTIRETY AND CHANGE THE MINIMUM BUILDING SITE AREA FROM 40,000 SQUARE FEET TO 43,560 SQUARE FEET IN CHAPTER 17.24 ENTITLED " R-1-40 SINGLE-FAMILY RESIDENCE DISTRICT".WHEREAS, in 1984, the City Council approved an ordinance amendment establishing the R-l-E one-acre estate residence district requiring a minimum building site area of 43,560 square feet; and WHEREAS, since its creation, the R-l-E classification has been used infrequently; and WHEREAS, most of the properties which now have the R-1-40 classification are located in Orange Park Acres; since adoption of the Orange Park Acres Plan in 1973 the full one-acre site minimum has been the standard in the R-1-40 District; and WHEREAS, the City Council has determined that existing City policy would be enhanced by changing the minimum lot size requirement in the R-1-40 District from 40,000 square feet to 43,650 square feet and eliminating the R- I-E classification entirely; these changes would eliminate the need to rezone individual properties and assure that all future subdivisions and annexation would conform to the one-acre lot size.NOW, THEREFORE, the City Council of the City of Orange ordains as follows:Section I:Title 17 of the Orange Municipal Code is amended to delete in its entiretyChapter17.25 entitled "R-l-E One-Acre Estate Residence District".Section II:Section 17.24.030 of Chapter 17.24 entitled "R-1-40 Single Family ResidenceDistrict" is amended to read as follows:17.24.030 Uses Permitted. The following uses shall be permitted in an R-1-40, Single Family District: All uses permitted in the R-1-6 District and R-1-20 District, subject to the restrictions and regulations of such districts, except that the minimum buildingsiteareaforeach R- Section III: A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the city Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance's passage in the Orange City News, a newspaper of general circulation, published, and circulated in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted Ordinance along with the names of those City Council members voting or and against the Ordinance in accordance with Government Code section 36933. This Ordinance shall take effect thirty (30) days from and after the date of its final passage. ADOPTED this 20th day of June 1989.
