ORD-43-88 CONCERNING THE ISSUANCE OF DEMOLITION PERMITS FOR BUILDINGS AND STRUCTURES IN THE OLD TOWNE DISTRICTORDINANCE NO. 43-
88 AN INTERIM ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF ORANGE EXTENDING THE
EFFECTIVITY OF ORDINANCE NO. 37-88, AS
AMENDED BY INTERIM ORDINANCE NO. 42-
88, CONCERNING THE ISSUANCE OF DEMOLITION
PERMITS FOR BUILDINGS AND STRUCTURES IN THE
OLD TOWNE DISTRICT.WHEREAS, the City Council has adopted a
permanent Old Towne Demolition Ordinance No. 39-88 which
will become effective on
November 25, 1988; and WHEREAS, the interim measure,
Ordinance No. 37-88, shall become null and void on November 4,
1988, unless
its effectivity is extended; and WHEREAS, the City Council wantsOrdinanceNo. 37-88 to remain in effect untilthepermanent
demolition ordinance becomes legally binding; and WHEREAS, the Council by
adoption of this Interim Ordinance No.43-88 extends theeffectivityofOrdinanceNo. 37-88 until August 15, 1989,
or until Ordinance
No. 39-88 becomes effective, whichever event occurs first.NOW, THEREFORE,
the city
Council of
the City of Orange ordains as follows:Section I:Amend Section
IV
of Interim Ordinance No. 37-88 to read as
follows:Section IV: This Interim Ordinance No. 37-88 shall
become effective immediately and shall remain in force until August
15,1989, unless sooner repealed by the cityCouncil, or until Ordinance No. 39-88 becomes
effective, whichever event occurs first. When Ordinance No. 39-88
becomes effective, Interim Ordinance No. 37-88, as amended, and InterimOrdinance
No. 43-
88 shall become null and void without further action oftheCityCouncil.Section II:
The facts justifying the enactment of this Ordinance as an interim
measure are as follows:The facts stated in Section V of

why this Ordinance No. 43-88 is being adopted as an interim
measure is that Interim Ordinance No. 37-88 will become
null and void on November 4, 1988, and the permanent Old Towne
Demolition Ordinance No. 39-88 will not become effective
until November 25, 1988. If the effectivity of Interim Ordinance
No.37-88 is not extended beyond November 4, 1988, then
nothing would prohibit the demolition of historically or
culturally significant buildings and structures in the Old Towne District.
The City council has determined the public health, safety
and welfare justify urgency enactment under the provisions of section
65858 of the California
Government Code.ADOPTED this 1st day
