ORD-38-88 DESIGN STANDARDS FOR THE OLD TOWNE AREA SET FORTH IN THE HISTORIC PRESERVATION DESIGN GUIDELINES FOR OLD TOWNEORDINANCE NO. 38- 88 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE ADOPTING, BY REFERENCE,DESIGN STANDARDS FOR THE OLD TOWNE AREA AS SET FORTH IN THAT CERTAIN DOCUMENT ENTITLED "HISTORIC PRESERVATION DESIGN GUIDELINES FOR OLD TOWNE, ORANGE,CALIFORNIA, DATED AUGUST, 1985, WITH SPECIFIC CHANGES AND MODIFICATIONS,STATING REQUIREMENTS FOR IMPLEMENTA-TION, WITH PENALTIES FOR VIOLATION.ADDED TO ORANGE MUNICIPAL CODE AS CHAPTER 17. 70.WHEREAS, on August 20, 1985, the City Council adopted Resolution No. 6431 which approved that certain document entitled Historic Preservation Desiqn Guidelines for Old Towne. Oranqe.California," and WHEREAS, these guidelines have been used and tested for more than three years; and WHEREAS, the City Council has determined that the subject document should be adopted by reference and that the provisions thereof shall be implemented as mandatory design standards.NOW, THEREFORE, the City Council does ordain as follows:Section I:Title 17 of the Orange Municipal Code is hereby amended by adding Chapter 17.70 to read as follows:DESIGN STANDARDS FOR THE OLD TOWNE AREA 17.70.010 Purpose and Boundaries. A. The purpose of this Chapter is to implement the design standards for those projects in the Old Towne Area set forth on Page 10 of that certain document entitled "Historic Preservation Desiqn Guidelines for Old Towne.Oranqe. California", dated August, 1985.B. The design standards adopted by reference in section 17.70.020 shall be applicable within the Old Towne area, more specifically described as follows:Batavia Street on the west, Cambridge Street on the east, Walnut Avenue on the north, and La Veta Avenue on the south, including the Nutwood'Tract on the south side of La Veta Street. The boundaries of the Old Towne area shall run along the centerline of the designated streets and the borders of the Nutwood Tract. 17.70.020 Adoption. That certain document entitled "Historic Preservation Desiqn Guidelines for Old Towne. Oranqe. California," dated August, 1985, adopted by the Orange city Council, with any changes or modifications as are herein set forth in this Chapter, is hereby adopted by reference. 17.70.030 Chanqes and Modifications. That certain document adopted by reference in Section 17.70.020 shall include the following specific changes and modifications: A. The wording of page 10, paragraph 2) concerning the prohibition of certain architectural styles shall not be construed as to prohibit any such style of buildings or structures which are existing when this Chapter is adopted and for which the owner has not applied for a permit to substantially alter the building or structure. B. Each reference to "Old Towne Overlay Zone" of "Old Towne Overlay Zones" shall read "Old Towne District". 17.70.040 Amendment. Provisions of this Chapter, including that certain document adopted by reference in Section 17.70.020, may be amended, modified, added to, deleted from, repealed or rescinded either by ordinance or resolution of the city Council. 17.70.050 Appeals. Any person aggrieved by an interpretation of any part of this Chapter or the manner which any part of this Chapter is administered by any City board, commission, or admin- istrative official may appeal the matter to the City Council in accordance with procedures established by the Director of Community Development Services. 17.70.060 Violation. A. Any person, firm, or corporation violating any of the provisions of this Chapter, shall be deemed guilty of a misdemeanor, and each such person and every day or portion thereof during which any violation of any of the provisions of this Chapter is committed, continued, or permitted, and upon conviction of any such violation such person shall be punishable by a fine of not more than five hundred dollars ($500) or by imprison- ment for not more than six (6) months, or by both such fine and imprisonment. B. In addition, provisions of this Code may be enforced by injunction or other appropriate civil remedy.
